1. The Land Contract Has Fully Closed

-Contract merged into the deed

2. The Land Contract Is Terminated or Canceled

-Mutual written termination
-Buyer default and contract termination
-Seller forfeiture (if allowed by contract)
a. Release as soon as termination is effective Leaving it of record after termination improperly clouds title.
3. The Contract Has Expired by Its Own Terms
-Option period ended
-Time-limited contract expired without closing
a. Release once expiration occurs
4. A Replacement Instrument Has Been -Recorded
-Deed in lieu
-Assignment or novation that supersedes the original contract
a. Release original memorandum
5. Upon Written Demand by Seller or Title Company
-WV recognizes that unreleased memoranda can create a false cloud on title
-Title insurers routinely require a release before closing any later transaction
a. Release promptly to avoid title objections
When a Memorandum SHOULD NOT Be Released
-While the contract is still active
-Before buyer’s equitable interest ends
-Without authority (unless unilateral release rights exist)

I thought the instructions could have been a little better. I didn't know how to do this if the spouses are married but living in separate residences. Also I didn't understand the "Prior Instrument Reference". That should be explained better. Very sketchy instructions.

THIS SERVICE IS DIFFICULT TO USE AND TROUBLESOME, IN MY PROFESSIOBAL OPINION; a true NUGHTMARE! As a Title / Petroleum Land Professional (Landman), I use a wide variert of online title research tools and services. Mist are EXTREMELY COMPREHENSIVE, and relatively easy to perform one’s research. I am beginning to beliece that there is no search intrrfaxe here; just a long list of instructions full of circular references that simply tuns the researcher around and around to the same pages repeatedly. This service takes users NOWHERE. Good luck to those seeking to waste their time reading a vast set of redundant words and NO INTERFACE FOR CREATING OR EXECUTING AN AXTUAL SEARCH.

I had worked for a couple of months sending things back and forth to the county and still had no success. I decided to use deeds.com and it was all done in a few hours. Such a relief! While I find this to be wrong and the county should work with property owners as well as they work with third parties, I was still grateful for this service.
