Under Wisconsin Statutes section 705.15, owners of real property in Wisconsin may designate one or more people to gain ownership of their property outside of the probate process. The transfer on death deed form contains the designation and must be recorded, DURING THE OWNER'S NATURAL LIFE, for validity.
By executing and recording a transfer on death beneficiary designation, the owner retains absolute control over the real estate, and may sell, mortgage, or use the property in any legal manner, and change or revoke the beneficiary designation without penalty or obligation to inform the beneficiary.
Because the transfer does not occur until after the owner's death, there is no transfer tax due when recording the deed under 77.21(1) and 77.25(10m). While the change in ownership happens as a function of law when the owner dies, when the beneficiary claims the land, he or she must record form TOD-110 to make the transfer official and enter the updated information into the public records.
Wisconsin's transfer on death deeds are useful estate planning tools. Even so, carefully consider the potential impact of a non-probate transfer of property on taxes, as well as eligibility for local, state, and federal benefits. Not good. The blanks on the form, supposedly especially tailored for the specific county, didn't have enough space for a document name or the doc #. I had to retype the whole doc myself.

Ordered the forms I needed for my state and county and everything worked out perfectly. All the forms came with examples (filled in) and very detailed instructions for each block that required an entry. The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem. Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description! Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.

It was easy to download the form I wanted BUT there were 2 other options listed for "open/download." I didn't want to risk more charges for something I couldn't determine I needed so I passed them up. There were a few others listed with the option to "view" so I did that, without down-loading, and there were no additional charges. I would've liked that opportunity for 2 others that didn't offer "view" so maybe deeds.com missed a sale?
