StatewideArk. Code Ann. § 21-6-306(a)(1)(C) sets a fee of $8.00 for filing or recording a certificate of assessment or any other instrument not specified in subsection (a). Fees under § 21-6-306 are paid into the county recorder's cost fund.

Transfer tax

Real Property Transfer Tax. $1.10 for each $1,000 or fractional part thereof when consideration exceeds $100, plus an additional tax of $2.20 for each $1,000 or fractional part thereof. The tax is collected when the document is recorded. (statewide, Ark. Code Ann. § 26-60-105)

StatewideThe tax is based solely on the consideration given for the realty, not on tangible or intangible personal property included in the transfer (Ark. Code Ann. § 26-60-105(c)). Payment is shown by documentary stamps or a documentary symbol attached to the face of the instrument; on receipt, the county recorder cancels the stamps or symbol or notes on the face of the instrument that it is exempt or that no tax is due (Ark. Code Ann. § 26-60-107).

StatewideDocuments must contain the title of the document and the name of the grantor and grantee, when applicable, be acknowledged or otherwise executed as permitted by § 16-47-107 or § 18-12-208, and be legible. The recorder has discretion to waive these requirements for good cause and for documents complying with the Uniform Real Property Electronic Recording Act. Documents executed before January 1, 2004, and all surveys and plats are exempt. The preparer's name must be printed, typewritten, stamped, or signed legibly.

Documents must have original signatures or be certified by a court or agency of competent jurisdiction. All deeds must have the following affidavit signed by the grantee or his agent: "I certify under penalty of false swearing that documentary stamps or a documentary symbol in the legally correct amount has been placed on this instrument." Any variation from this statement will result in the return of the document without recording. Any font less than eleven (11) could cause the document to be illegible. Taped-on or reduced legal descriptions are often illegible. A cover sheet must have a top margin of 2 1/2". This office is not re-recording instruments unless pre-approved.

StatewideA deed to real estate presented in person or by mail is not received for record unless the grantor named in the deed, or an individual signing on the grantor's behalf, appears in person at the recorder's office and presents a valid photo identification card or driver's license issued by a state agency or a United States government agency; for a deed presented by mail, a photocopy of the grantor's valid photo identification or driver's license is included. The recorder records a copy of the identification attached to the deed. This does not apply to deeds presented by an attorney; a real estate broker or agent; a representative of a bank, mortgage company, or lending institution; a title insurance agent, agency, or affiliated person; the Commissioner of State Lands; an individual representing the state or a political subdivision; or the state, a municipality, a county, or a political subdivision.

Documents mailed to the office should not be folded; mail them in large envelopes.
