The Office of the Clerk and Recorder is responsible for maintaining land records for real property located in Weld County.

Recording Fees

$13 for the first page of all recorded documents

$5.00 for each additional page ($10.00 for each additional page on documents larger than legal size)

Documentary fee: $0.05 per $500 dollars of applicable sales consideration
The consideration amount must be clearly marked on the deed and the transfer declaration. Some documents may be exempt from this fee.

Documents received with insufficient fees (recording and documentary fees) will be returned unrecorded. Checks should be made payable to "Weld County Clerk and Recorder" or WCCR." A return envelope is appreciated, but not required.

Document Formatting Requirements

* Originals should be of good quality, readable, and able to produce a legible copy. Bad originals produce poor public records. Illegible documents will be marked with a Clerk's note and recorded as received.

* Documents should be sent in the order in which they are to be recorded. If necessary, provide instructions on the order of recording.

* All documents should have a top and bottom margin of at least 1 inch. Side margins should be at least .5 of an inch. The recorder may refuse to file any document that does not meet these standards.

* A valid grantee's address should be included in the deed. This address is used to determine where future tax statements should be mailed after a property is sold. Submitters should verify the accuracy and completeness of this address before the deed is recorded.

* A complete and accurate return address should be clearly marked on the document.

* Both the grantor and the grantee need to be named in the deed. The grantor must sign the form and must have his/her signature acknowledged or proved.

* Provide an accurate and complete legal description for the real property. If an instrument contains a newly created legal description, provide the name and address of the person who created the legal description.

* Immediately before or after the legal description, provide the street address or other comparable identifying numbers, if such address or numbers are displayed on the property. As an aid to identification, provide the assessor's parcel or schedule number pertaining to the property.

* All instruments wherein the parcels of property affected are not separately enumerated or listed but are described as being from one numbered, lettered, or designated parcel to another shall be construed as including the first and last designated parcels and also the intervening parcels, unless a contrary intention is expressly and clearly set forth in the instrument.

Any conveyance document presented for recording shall be accompanied by the Colorado Real Property Transfer Declaration (TD-1000). The consideration amount must be correctly marked on both the deed and transfer declaration.
