Transfer tax will be collected on the consideration stated in the deed. The tax will be imposed upon the grantor at the rate of 50 cents per $500 of value or fraction thereof.
On a deed of correction, transfer tax will only be collected if the amount of consideration has changed. A deed cannot be legally lodged for record until the tax due is paid.

Document Requirements

AFFIDAVIT OF CONVERSION TO REAL ESTATE

This document is filed to execute a conversion of a manufactured home (mobile home) permanently to real estate. Requirements to record:

- The Kentucky title must be free of lien notations.

- The document must have the owner's signature, notarized signatures, and a return mail address.

- For this type of document, a preparation statement is not required.

- The deed book and page number of the property where the manufactured home is to be permanently affixed must be referenced on the affidavit of conversion. A legal description of the property is not required.

ASSIGNMENT

This instrument is generally used when a mortgage holder transfers his interest in a mortgage to another. Requirements to record:

- First party, second party, and their mailing addresses.

- The name of the party or parties who executed the original mortgage.

- The mortgage book and page reference of the original mortgage.

- A preparation statement and a return address. A preparation statement includes the author's name, address, and signature.

- Must be signed by the assignor and notarized.

DEED

- First party, second party, and their mailing addresses.

- A consideration statement, a legal description of the property, and the source of title. The grantor and grantee must both sign the consideration
statement; the consideration statement must be notarized.

- A preparation statement (name, address, and signature) and a return mailing address.

- The deed must be signed and acknowledged by the grantor.

EASEMENT

- Document must have the first party, second party, and their mailing addresses.

- A statement of consideration signed by both parties and notarized.

- A legal description of the property, the address of each parcel, and the source of title.

- A preparation statement (name, address, and signature) and a return mailing address.

- Documents conveying only utility easements do not need a consideration statement.

MORTGAGE

This is also known as a deed of trust or indenture of trust. Requirements to record:

- First party, second party, and their mailing addresses.

- Amount of the mortgage, maturity date, and a legal description of the property.

- A preparation statement (name, mailing address, signature) and a return mailing address.

- Must be signed by the mortgagor and notarized.
