The County Clerk is responsible for recording and maintaining records related to real property situated in Niobrara County.

Recording Fees

As per Wyoming Statute 18-3-402 (XVI), effective July 1, 2013:

To record the first page of a document, the fee is $12. Each additional page is $3.

Acknowledgments are $2.

If an instrument has more than 5 grantors or grantees of a different surname, the fee is $1 per each additional name.

For each section, block, lot, or tract description in excess of 10, the fee is $1 per additional description.

For an instrument that contains more than two real estate descriptions by book and page only, the fee is $2 per each additional description.

Recording fees must be paid in advance.

Document Formatting Requirements

- If a document is legible but not sufficiently clear enough to produce a readable copy, the clerk may require the person to substitute a clear original or legible true copy of the original document. The county clerk may prepare a true copy by handwriting or typewriting and attach the same to the original as part of the document. The county clerk shall charge a fee of $0.50 per 100 words for preparing a true copy.

- White paper measuring at least 8.5x11 inches or 8.5x14 inches should be used. To ensure legibility, black ink with a font size of at least 12 point is suggested.
- Upon recording, the county clerk will stamp recording information on the first page. A margin of at least 3 inches should provide enough space.

- The execution of deeds, mortgages, or other conveyances of lands or interests in lands shall be acknowledged by the party executing the same, before any notarial officer.

- The grantor and grantee must be named in the instrument, along with a title and a date. The county clerk will not record a document until the grantee's address is furnished.

- The amount of consideration should be listed in the document.

- A legal description of the real property being conveyed is required. If a map delineating the land has been previously recorded, the deed may make reference to the recorded map.

STATEMENT OF CONSIDERATION

Wyoming Statute 34-1-142 requires a Statement of Consideration to be completed whenever a deed, contract, or other document transferring legal title to real estate is recorded. This statement should disclose the name of the grantor and grantee, the date of transfer, date of sale, a legal description of the property transferred, the actual full amount paid or to be paid for the property, terms of sale, and an estimate of the value of any non-real property included in the sale. This is a confidential tax form and is not a matter of public record.
