California Certification of Trust

In California, the certification of trust is governed by Probate Code Section 18100.5.
A certificate of trust is used by an acting trustee or trustees of a trust to prove to financial institutions or other third parties that he/she/they has/have the authority to act on behalf of the trust. The certificate is used in lieu of the full trust document to keep nonessential information about the trust, such as the identities of trust beneficiaries, confidential.

The certificate verifies the existence of the trust and presents the pertinent details of the trust, such as the settlor, the trustee, the powers granted to the trustee, and, in the case that there are co-trustees, the number and identity of persons required to sign legal documents dealing with the trust. The certificate also specifies how the trust will vest title to real property.

Like all documents affecting real estate, the certification requires a legal description of the real property subject to the trust. In California, the certification also must include the trust's taxpayer ID, a number that is either the SSN of the settlor (in the case of revocable trusts) or an EIN assigned by the IRS (in the case of irrevocable trusts).

Best Way EVER to record a warranty deed! It was nice to not have to drive anywhere and find the facility closed or "unable to process due to covid19 and buildings being closed". South Carolina Warranty Deed document is good. The example and instruction documents are marginal help for Trusts.

The booklet is too wordy. Not concise enough for someone who is inexperienced at filling out your form. It would be nice to have a picture example of what you are talking about. When we got to the Registars office we found out they do not have a notary. Would have been nice to know before we went. The form asks for page and book which is no longer needed. So why have it on there?

A completed sample is actually included with the form, and your note tells us we should make it easier to find and tie it more directly to the instructions, so we'll do that. We'll also add a "before you begin" checklist and a clearer note that the document needs to be notarized in advance, since recording offices don't provide notary service. On the book and page: that reference is required by the Utah statute this affidavit is filed under (§ 57-1-5.1) and still applies to older deeds recorded before counties moved to entry-number-only indexing around 2000. You enter whichever reference appears on your recorded deed and leave the rest blank. Appreciate you taking the time to write in.

Bottom line - it was certainly worth the $21 (+-?) I paid for the form and instructions, etc. Admittedly the form is a little inflexible in terms of editing for readability but I understand that offering greater flexibility would likely make theft more likely. So I'm happy with what I got. One suggestion - add more info about what's required in the "Source of Title" section.

I followed the instructions to download the form for my Mac, typed in the legal description of the real property but the space provided for it would not expand so I just typed the form into Word as a document. While I appreciate having the form to work with it would have been a breeze if it worked properly.
