The Release of Memorandum of Agreement is a document that states the original purchase agreement (and its corresponding memorandum) is no longer valid or enforceable.
The release should include: Names of the parties involved (both the buyer and seller). Property description (legal description and address). Recording information from the original memorandum (such as the recording number, date of recording, and where it was recorded). A statement that the memorandum of the purchase agreement is released, and the purchase agreement is no longer effective.
Signatures of the parties involved (at least the vendor/seller, but preferably both the buyer and seller, unless otherwise stipulated).
Sign the Release
Typically, both parties (the buyer and seller) should sign the release document.
However, if the agreement or specific circumstances allow for only the seller to sign the release, ensure this is explicitly permitted in the purchase agreement.
The signatures may need to be notarized to make the release effective for recording. Ensure each party signs in front of a notary public, who will then notarize the document.
Notarization
The release must be notarized to be legally recognized and recorded. Notarization confirms the identity of the signers and the authenticity of their signatures.
Each party (or just the seller, if applicable) should sign the release in front of a notary public who will complete the notarial acknowledgment.
Record the Release Document
Once the document is signed and notarized, it needs to be recorded with the County Clerk and Recorder's Office in the county where the property is located.
Recording the release is essential to formally remove the memorandum from the public record and clear the property's title.

I am so glad I found this resource! As the Executor of a family members estate I wanted to save money by bypassing a lawyer as it seemed pretty straight forward to tranfer a Life Estate to the remainderman. (I had original deeds). But talking with 3 different states and 4 different counties - none of which seemed to need the same documents, I was almost ready to dump this in a lawyer's lap. This resource makes it simple!

Your instructions and sample are geared towards businesses. It would have been helpful to have included some for us individuals as married couples as well. I also recall one or two spelling errors on the form that I could not fix, and the instructions seem to be for a prior form. This particular registry also required a stamped self-addressed envelope for return of documents. Hey, you asked! Overall, pleased.

The forms worked well for entering information. I have finished without much trouble. Since the forms are Adobe PDF files you need the free app to use them but you can't edit unless you have the paid Adobe program. And, it was a reasonable price.

This site was easy to use for access to State forms for filing in Montmorency County clerks office. Not only did I find claim form but a sample claim was available for assisting on how to complete your form correctly. Found this so very useful for us (public resident) to fill in the form as a .PDF file that prints out typed form - rather than handwritten entries. There is a fee but your access is always available on internet to this site in the future. Saved me time using this site and My filed form looks professional. You have access to several other forms if needed.

The fill-in pdf produced a messy document and several of the fields too small to accommodate the text. A tailorable MS Word document would have been far better. I would not recommend using this product.
