In Colorado, the person approved or appointed by the probate court to administer a decedent's estate is called a personal representative. The personal representative has a fiduciary duty to settle the decedent's estate, including devising real property to rightful heirs or distributing real property pursuant to the laws of intestate succession set forth in the Colorado Probate Code.

Use the personal representative's deed of distribution to transfer real property to a devisee (someone designated in a will to receive the decedent's property) or an heir (a person, including the surviving spouse, entitled under statutes of intestate succession to receive the decedent's property).

The personal representative's deed does not warrant against title defects preceding the appointment of the personal representative.

I thought the instructions could have been a little better. I didn't know how to do this if the spouses are married but living in separate residences. Also I didn't understand the "Prior Instrument Reference". That should be explained better. Very sketchy instructions.

Thank you for your feedback Lanette. In review, it looks like your first payment was declined, second one was approved and processed. What you are seeing is one payment and a hold placed by your financial institution for the declined attempt. We are not sure why they do this but the hold usually falls off after a few day depending on their policy. If you have further questions about this you can contact your financial institution and they will explain. Have a great day.

I find your forms hard to use, inasmuch as the forms cannot be converted to a Word Document. Editing and deleting of extra lines is not possible, making for a deed with large blank spaces. Document that results is not usable for me.
