Delaware's tax statute keeps its own name for this instrument: a correctional deed. The corrective edition of the Delaware quitclaim deed repairs a defect in a deed already recorded rather than moving title anywhere new. It points back to the earlier deed by parties, date, and recording reference, sets the defect against the corrected text, and takes the signature of the grantor who signed the first time, with no covenant of title attached.

The Class Delaware Calls Correctional

Realty transfer tax reaches only a document as 30 Del. C. § 5401(1) defines that term, and paragraph l. of the definition places correctional deeds without actual consideration outside it. The counties follow the state list, so the transfer tax articles of the Kent County Code and the Sussex County Code carry the same exclusion against the local portion. Actual consideration is the hinge: money changing hands on the second instrument pulls it back into the taxable class. The Division of Revenue return and affidavit of gain and value still rides to the recorder with a correction deed.

What the Corrective Edition Recites

This edition is a second deed tied to a first, so its entries run in two registers. One identifies the recorded deed being repaired: its grantor and grantee, its date, the county, and the book and page or instrument number it recorded under. The other carries the repair, stating the defect as the record shows it and then the corrected text. The original grantor signs, one acknowledgment certificate accompanies that signature, and consideration is nothing beyond the original transfer. Where a correction reaches the boundaries themselves, practice in the Delaware record shows the grantee joining as well. Misspelled surnames, transposed lot numbers, and a plat book cited to the wrong volume are the defects this pattern answers. Its boundary is equally plain: an instrument that adds a party the first deed never named, drops one it did, changes the tenancy the grantees took, or reaches land the original description never covered is a fresh conveyance rather than a repair.

Release Words on a Deed That Adds Nothing

Delaware builds a covenant into ordinary granting language: 25 Del. C. § 121(b) makes the unrestricted words grant and convey operate as a special warranty binding the grantor and all who claim under the grantor. A corrective instrument in quitclaim form is drafted the other way, through release wording or an express restriction, so the second deed leaves no warranty behind it. One consequence deserves plain statement: a corrective quitclaim carries no covenant of its own and neither restores nor enlarges whatever warranty the original deed carried. Priority runs from recording, not signing (25 Del. C. § 153).

Delaware's Other Repair Routes

No Delaware statute prescribes a form for this instrument and no reported decision construes one, so its content follows title practice and the deed conventions of 25 Del. C. § 121. A record whose notarial certificate was defective or absent is validated by 25 Del. C. § 132, as effective in law as if the acknowledgment had been certified correctly, and the counties re-record an original document with corrections rather than void what already stands recorded. For a defect running deeper than the paperwork, the Court of Chancery reforms an instrument that fails to express the parties' real transaction, on clear and convincing proof of mutual mistake or of one party's mistake met by the other party's knowing silence.

Three Counties, Three Rulebooks

Recording format in Delaware is county law: 9 Del. C. § 9605(g) puts paper size, type size, margins, and blank-space regulation in the hands of each county's recorder of deeds, and the three published standards diverge on the first-page reserve, on the placement of the parcel and preparer data, and on the type floor. Because a correction deed drawn for one counter can arrive nonconforming at the next, this product is researched jurisdiction by jurisdiction, and the purchase delivers the edition matched to the recording county: New Castle County, Kent County, or Sussex County. Both statewide acceptance gates hold in all three offices: the tax parcel number appears conspicuously (9 Del. C. § 9605(f)) and page one names whoever drafted the instrument (9 Del. C. § 9605(h)).
