Two record owners convey together on this fillable Hawaii warranty deed: the form recites two grantors, sets a signature line for each, and closes with two acknowledgment certificates, one per signer. Both grantors join in a single conveyance of Hawaii real property with full title covenants, prepared for the Bureau of Conveyances in either recording system.
A deed built around two grantors
The grantor section carries two entries, each taking one owner's full legal name, marital status as Hawaii practice recites it, and mailing address. The signature section pairs the two owners on one page, each signing above a printed name as Hawaii Revised Statutes Section 502-31(b) requires. A separate notary acknowledgment certificate follows for each grantor, an architecture the form carries rather than a statutory command, so the two signatures may be acknowledged on different dates, before different notaries, on different islands or in different states; the completed example shows one grantor acknowledging in Honolulu and the other on Maui four days later. Several ownership patterns present this two-grantor architecture in the record: a married couple, civil union partners, or reciprocal beneficiaries holding as tenants by the entirety; two joint tenants passing the whole title in one sale; and two tenants in common consolidating both undivided shares in a single grantee. A sole record owner, a group of three or more co-owners, an entity, or a trustee presents signature and recital architecture this form is not set up to carry; it recites exactly two natural persons conveying in their own right.
Entireties title and why both owners sign
Hawaii extends the tenancy by the entirety to spouses, civil union partners, and reciprocal beneficiaries under Section 509-2, and the estate's defining incident is joint action: neither owner alone conveys or encumbers entireties land, and under Sawada v. Endo the separate creditor of one owner cannot reach it during the joint lives. A conveyance out of an entireties title therefore arrives at the Bureau as exactly what this deed frames, one instrument carrying both owners' signatures and both acknowledgments. Two joint tenants stand differently as a matter of law, since either could convey a half interest alone and sever the survivorship, but a pair of joint tenants intending the grantee to take the whole likewise join in one instrument so the entire fee passes with every covenant behind it.
Full covenants from each grantor
Hawaii writes no statutory short form for warranty deeds; the covenants live in the instrument's own text or nowhere. The granting clause here runs from the grantors, and each of them, with the words GRANT, BARGAIN, SELL, AND CONVEY, and the covenant paragraph states seisin in fee simple, good right to convey, freedom from encumbrances outside the deed's listed exceptions, quiet possession, and the promise to WARRANT AND DEFEND the title against the lawful claims of all persons. The exceptions list marks the covenant boundary: a mortgage the buyer takes subject to, and the easements and covenants of record, sit outside the warranty when stated there.
First-page data both registrars look for
Page one follows Hawaii's statewide intake layout: the registrars' 3.5 inch band stays empty at the top, the return address block occupies the strip beneath it starting 1.5 inches from the left edge, and the deed's own text then opens with the recording system entry, the tax map key (TMK), and the Land Court certificate of title line, joining the parties and the document type that Hawaii Administrative Rules Section 13-16-4(c) places on the first page. One layout serves Regular System recording, Land Court registration, and dual-filed parcels. At intake the deed travels with the state conveyance tax certificate, Form P-64A computing the tax on the actual and full consideration or Form P-64B claiming an exemption, because Section 247-6 bars recording without it; that certificate is a Department of Taxation form prepared separately and is not part of this package.
