This Kentucky warranty deed is set up for a single individual grantor conveying real property with the statutory general warranty of KRS 382.030. The form recites one grantor's full name, mailing address, and marital status, carries one grantor signature block, and includes the sworn consideration certificate that Kentucky recording law places on nearly every purchase deed.

The statutory words that carry the warranty

Kentucky attaches its broadest title covenant to three words. Under KRS 382.030, a conveyance made "with general warranty" carries a covenant that the grantor and the grantor's heirs will forever warrant and defend the property against the claims of all persons, reaching the whole chain of title rather than only the grantor's own period of ownership. Kentucky recognizes a narrower special warranty under KRS 382.040; this deed carries the general warranty words, printed in the operative section so the covenant arises exactly as the statute frames it. No official state deed form exists in Kentucky, so the statutory words themselves do the work.

A sworn certificate signed by both sides

KRS 382.135 gives Kentucky deeds a feature few states use: a sworn, notarized consideration certificate signed by the grantor or an agent and the grantee or an agent, stating that the consideration reflected in the deed is the full consideration paid for the property. The county clerk is barred from lodging a deed without it, and a false statement of consideration is a Class D felony under KRS 382.990. This form builds the certificate into the deed: a fixed certificate sentence, a signature line for each party, and a notarial certificate for each signer, with the grantee's signature line marked as covering the consideration certificate only.

What the deed recites for the record

Kentucky county clerks check deed content at the counter. This form carries the immediate source of title KRS 382.110 requires, identified by office, book, page, and date; the full names and mailing addresses of the parties and the in-care-of address for the property tax bill under KRS 382.135; and the signed preparer endorsement KRS 382.335 requires before a clerk may receive the instrument. The stated consideration is also the base for the real estate transfer tax, which the clerk computes at fifty cents per five hundred dollars of value under KRS 142.050 and collects before the deed is legally lodged.

Built around one individual grantor

The deed recites exactly one grantor acting in an individual capacity. A sole record owner conveying the whole fee, whether selling a residence or transferring investment property, presents the pattern this deed recites: one granting party, one acknowledgment, and a marital status entry on the face of the deed. The form is not set up as a joint conveyance or a spousal joinder deed; two co-owners conveying together, or a married grantor whose spouse joins to relinquish statutory dower or curtesy under KRS 392.020, present signature configurations this form does not carry. The grantee side stays flexible: one or more grantees may take title, with any Kentucky-recognized vesting designation following their names in the grantee section.

Recording with the county clerk

The completed deed is recorded with the county clerk of the county where the property is located, on letter size pages with a three inch first page top margin matching the county recording standard the form follows. Very disappointed that you had certain documents but did not have the accompanying documents needed to complete the transfer. I also had issues with the documents not allowing you to fill in the pages... example the document was prefilled in as so ... Page 1 of_____ but you could not fill in the blank... I tried reaching out to your customer service, but they had no solution for me. So, I had to write in the page, which didn't look professional. I think I could have gotten documents just as good for free if I'd research a little longer.

The Virginia Transfer on Death Deed and the Virginia Transfer on Death Beneficiary Affidavit are separate documents and are offered individually because many customers only need one, depending on their situation. In your case, the affidavit was later ordered separately.

Regarding the page numbering (“Page 1 of ___”), that field is intentionally left blank. The total number of pages is not known until the document is finalized, signed, notarized, and all attachments (such as exhibits or legal descriptions) are included. It is standard practice to complete that portion by hand at execution so the final page count accurately reflects the recorded document.

Glad to have all of the helpful extra information, even though they don't answer all questions for all situations. So, I accessed public records and asked questions at the auditor's office. Also, on my Mac computer, filling out the actual deed form is a challenge because the screen jumps to the last page everytime I try to type a few letters or hit the return key, so I'm rollling back up to the first 2 pages after most keystrokes. A bit annoying. Overall, happy to have these form options are available! There is really no need to wait and pay for an attorney when all the information needed is available via public records. Fill in the blanks!
