Lien waivers are used to facilitate payment between contractors, subcontractors, customers, and property owners. A waiver is a known relinquishment of a right. In this case, the person granting the waiver is relinquishing the right to seek a mechanic's lien for all or part of the amount due.
In general, there are two types of waivers: partial and final. A partial waiver is used when a progress or partial payment is made and money is still due and owing. The waiver applies only to the partial payment amount and is conditioned upon the actual receipt of that money (the check clears the bank). A final waiver releases all rights immediately. Be cautious about using the correct form of waiver, as partial waivers provide more protection to the lien claimant, while final waivers offer more protection for the customer or property owner.
The waiver must include details identifying the parties, the location of the project, relevant details from the original agreement such as work requested, costs and changes, important dates, payments, and any exclusions, conditions, or agreements. It also lists the dates covered by the partial waiver. The person waiving the lien gives a sworn statement in front of a notary, signs the form, and then records it in the property records for the county where the property is located.

It was OK but unfortunately useless. The jurisdictions are now requesting that documents such as Notices of Commencement not only be recorded at their offices, but also certified. This last service is not provided by Deeds, or at least I could not find it in your website and did not receive a response when I asked if you did. Thus, we are going back to traditional means of recording/certifying

The forms are extremely helpful. They could use some updating. Promissory note "...in the form of cash, check or money order." is a bit outdated. My note is with my son and we have an automatic bank transfer set up for payments. He could Venmo me. There are many other options and likely to be more changes in the future, so I know this is difficult to maintain.

Great to have a downloadable form, rather than a cloud solution that gives no guarantee of privacy. Appreciated the sample.......but all of that still left me with open issues about how to tweak the form to serve my particular needs......for example: how to ensure that survivor rights were properly characterized; how far back I should go with the "Source" section + how I should layer my own additions to the chain of ownership, etc. Nonetheless, an overall happy experience. I wasn't sure what I was looking for initially so I printed out the wrong thing. Had to pay again to get the right one but much less expensive than getting it from a lawyer. Our military lawyers will make the forms official but they don't have the forms. Hope this makes things easier for our children when we pass. Thank you for offering this service.
