Mortgage Deed and Security Instrument with Statutory Power of Sale

Use this form for financing real property, vacant land, rental units and small commercial property. (No conveyance in writing of lands shall be defeated nor any estate encumbered by an agreement unless it is inserted in the condition of the conveyance and made part thereof, stating the sum of money to be secured, or other thing to be performed.) (NH Rev Stat 479:2)

In order to record a mortgage it must contain (in the first sentence of the first description paragraph, the names of all municipalities in which the property is located)(NH Rev Stat 478:4-a(b))

(The words ""statutory power of sale'' shall be understood as giving the mortgagee and executors, administrators, successors and assigns the right, upon any default of the performance of the statutory condition as defined in paragraph II, or any other condition contained in the mortgage, to foreclose by sale under the provisions of RSA 479:25-27-a inclusive.) (NH Rev Stat Section 477:29 III) This can be very beneficial to the lender upon a default.

The Promissory Note also contains stringent terms and conditions such as late fees, default rates, obligations, etc. Can be used for conventional or balloon financing.

The paperwork/forms are fine, but there isn't enough explanation for me to figure out how to file the extra forms (which I do need in my case). The main form, Deed Upon Death is fine. I think the price is pretty high for these forms. I wouldn't have purchased it because there are places to get them for much cheaper (about 6 dollars), but this site had the extra forms I wanted (property in a trust and another form). Unfortunately these were included as a "courtesy" and there are no instructions for them. So three stars for being clear about what was in the package, having the right forms that I need, but instructions for putting them to use and price took a couple of stars off. Downloading was easy and once you download you can type the info into the PDF--that makes working with the forms much easier.

AMAZING! Easy to use, reasonable fee - and get MUCH MORE than just a deed form. I ordered a "deed" and received a whole "package," including a guide and the jurisdiction's costs schedule and cover page that would be needed to record the deed - even included a Certificate of Transfer that is not required for a deed but something I needed for a different transaction. The website was extremely easy to use and the cautions about not disclosing personal information were so clear and personal, they made me feel secure in knowing this site was not trying to rip me off. Very professional. Well done.
