Questions answered? Let's get started!

An easement is the right to use another person's real property for a specific purpose. This is a non-possessory interest in property, and can be either appurtenant or in gross. In North Carolina, the holder of a legal or equitable title of an interest in real property can create, grant, reserve, or declare valid easements, restrictions, or conditions of record burdening or benefiting the same interest in real property ( 39 6.4).

All real property documents in this state must be executed and acknowledged in strict compliance with the acknowledgment provisions in North Carolina in order to be recorded and to provide constructive notice. An easement deed must be signed and acknowledged by the grantor. An individual form for acknowledgment by a grantor is presented in 47 38 of the North Carolina Statutes. Acknowledgments must be taken before an officer who is authorized by the state to take acknowledgments of deeds. Documents that are executed and acknowledged out-of-state can be recorded in this state, but they must conform to North Carolina law.

A person who owns or acquires any deed or agreement for rights of way and easements of any character shall record such deeds in the office of the register of deeds in the county where the affected land is situated. If such deed or agreement has been acquired, but no use has been made of the easement, the person holding such instrument is not required to record it until within 90 days after the beginning of the use of the easement granted thereby ( 47 27). No deed, agreement for right of way, or easement of any character will be valid against any purchaser for valuable consideration but from the time it is registered with the register of deeds in the appropriate county in North Carolina ( 47 27).

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

It would help if pages of a document indicated 1 of 3 etc. When I downloaded the TOD guide I got a 4th page though it only showed 3 on the screen.

Great to have a downloadable form, rather than a cloud solution that gives no guarantee of privacy. Appreciated the sample.......but all of that still left me with open issues about how to tweak the form to serve my particular needs......for example: how to ensure that survivor rights were properly characterized; how far back I should go with the "Source" section + how I should layer my own additions to the chain of ownership, etc. Nonetheless, an overall happy experience. Thank you for your help
