A Memorandum of Installment Land Contract is typically recorded to provide public notice of a buyer’s equitable interest in real property under an installment sale arrangement. Once the underlying contract is satisfied, terminated, or otherwise no longer in effect, it is essential to release the memorandum of record.

Common reasons to release a Memorandum of Contract in Tennessee

1. The contract has been fully performed, and the deed has been delivered and recorded.

2. The contract has expired without full performance.

3. The contract has been canceled or terminated, whether by mutual agreement or default.

4. The memorandum was recorded in error or relates to an offer that has been withdrawn.

Why release is required:
Failure to record a release may result in a “cloud on title,” hindering the seller or buyer from subsequently selling, refinancing, or insuring the property, as the memorandum constitutes a recorded claim against the property.

its a bit confusing for a novice computer user. I would prefer to print out the forms, fill them out on paper, then attach them to an email to discuss the accuracy of the forms with a friend, and then take the completed forms to the County office to be recorded

The instructions and example for filling out the form were very clear and detailed making the whole process fairly easy. An attorney I talked to wanted $200 to fill out this simple form. I haven't tried to file it yet but I will let you know if there are any issues. Really a great deal. $20 vs $200.
