In West Virginia a Deed of Trust can be released by a Beneficiary/Lender or by a Trustee. This form is used by the current Lender, holder of the note or notes. For use when the note or notes have been satisfied and a full release is required. (Such release shall be executed and furnished to the debtor within thirty days after the debt has been satisfied.) (WV. Article 12. 38-12-1) (a))
Such release of lien shall be executed by the lienholder and acknowledged before the clerk of the county commission in whose office the lien is recorded or before such other person authorized to take acknowledgments of deeds. Such written release shall be deemed sufficient if it describes the lien to be released by any words that will identify and show an intent to discharge the same. Releases may also be made according to the provisions of section two of this article. (WV. Article 12. 38-12-1) (b))
38-12-8. Recordation of release; effect.
When the release has been so signed and acknowledged, it may be presented for record to the clerk in whose office the lien thereby intended to be released is recorded or docketed, and from and after the time the same is so left for record (which time the clerk shall endorse thereon) such lien shall be discharged and extinguished, and the estate, of whatever kind, bound or affected thereby, shall be deemed to be vested in the former owner or those claiming under him as if such lien had never existed
If a release is not executed as described, the lienholder can be liable to pay,( at the cost of the lienholder who so refuses without good cause and the court shall also award reasonable attorney fees and court costs to the person entitled to such release if such person be the prevailing party.) While it's nice to get all the forms and info in one package for a reasonable cost, the fixed format of the form does not allow for a lengthy meet and bounds property description for real property. Also, the Cover Sheet has big fillable sections with no instructions about what's supposed to go there. I tried the "Contact Us" link, but all it does is spin saying it's trying verify the security of my connection. Looks like I;m going to have to create my own deed in MS Word instead of just filling in the blacks of the PDF file that I downloaded. Bummer!

This was such a money saver. I was told by someone at the courthouse that I had to have a lawyer prepare the paper work for my mom. They stated that family members couldn't prepare the papers. I was hopeful when I found that I could prepare the survivorship affidavit on Deeds. I was able to prepare everything myself and had no issues today when at the courthouse for all the changes. Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.
