Under Wisconsin Statutes section 705.15, owners of real property in Wisconsin may designate one or more people to gain ownership of their property outside of the probate process. The transfer on death deed form contains the designation and must be recorded, DURING THE OWNER'S NATURAL LIFE, for validity.
By executing and recording a transfer on death beneficiary designation, the owner retains absolute control over the real estate, and may sell, mortgage, or use the property in any legal manner, and change or revoke the beneficiary designation without penalty or obligation to inform the beneficiary.
Because the transfer does not occur until after the owner's death, there is no transfer tax due when recording the deed under 77.21(1) and 77.25(10m). While the change in ownership happens as a function of law when the owner dies, when the beneficiary claims the land, he or she must record form TOD-110 to make the transfer official and enter the updated information into the public records.
Wisconsin's transfer on death deeds are useful estate planning tools. Even so, carefully consider the potential impact of a non-probate transfer of property on taxes, as well as eligibility for local, state, and federal benefits. Holy cow. I was told by several people that getting a deed recorded would take 7-10 days. So I thought I'd give deeds.com a try with their e-filing service. Deed.com is an amazing site. After calling many places and going on many websites to figure out what I needed to submit (most counties cannot help with questions and the place I needed to turn the documents into could not help either, they are not allowed to give legal advice) I came across Deeds.com. It has been so helpful and I was able to research what documents I needed. I purchased one document and after more research I realized I needed a different document. Deed.com refunded my first purchase. I then purchased an Affidavit of Death and a Deed for the county and state I needed them for. Both the example and guide were very helpful and I will be submitting my documents after I have them notarized. I give five stars

The experience was generally very satisfactory. I was able to fill out the Trust Deed and send it via email no problem. However, I was not able to send the filled out form of the Note. It always erased my fill-ins when it was sent. I found that very frustrating.
Thank you, Gordon. Glad the Trust Deed worked well. Issues like the one you reported with the Note can sometimes be related to how the file is opened or sent. Using Adobe Reader to fill, save, and send the form is recommended. We also pass along all feedback like this to our team to confirm there are no issues.

its a bit confusing for a novice computer user. I would prefer to print out the forms, fill them out on paper, then attach them to an email to discuss the accuracy of the forms with a friend, and then take the completed forms to the County office to be recorded
