About the Beaverhead County Recorder's Office

The Clerk and Recorder is responsible for recording and maintaining real property records in Beaverhead County.

Recording Fees

The recording cost for the first page of each document will be $20 and each additional page will be $10.

The non-standard fee was not affected and will continue to be a flat fee of $10. Additionally, filing fees were not impacted (COS's, plats, UCC's, liens, etc.).

Document Requirements

* A document consists of individual pages measuring either 8.5 x 11 inches or 8.5 x 14 inches. Paper should be white and of at least 20 pound weight.

* The text should be in black ink, legibly printed or typed, and with a minimum font size of at least 10 point. All signatures, initials, dates, handwriting, and notary stamps should be in blue or black ink.

* The first page should have a top margin of 3 inches. This should be left blank for recording purposes. Subsequent pages should have a top and bottom margin of 1 inch. All other margins should be a minimum of 1/2 an inch.

* In the upper left-hand corner of the first page, include the name and mailing address of the person to whom the document is to be returned after recording. This should be within the 3-inch margin and between the 1/2 inch side margins.

* On the first page of any document with more than one page, the names of the parties to the conveyance should be listed.

* A legal description of the real property should be provided. A street address or a deed reference is not valid legal description. The full metes and bounds, subdivision with lot numbers, or certificate of survey number must be included in the document.

* The grantor must sign the document and the signature must be acknowledged.

A completed Realty Transfer Certificate is required to be submitted with all transfers of real property, regardless of whether the transfer is or is not evidenced by deed or instrument. This confidential tax document can be accessed on the Beaverhead County Clerk and Recorder webpage.

The Realty Transfer Certificate must contain a water rights disclosure in which the transferor shall acknowledge, at or before closing or transfer of real property, whether or not any water rights are associated with the property to be transferred and whether or not any water rights will be transferred with the property.
