Who Can Sign a Memorandum?
According to § 38-10-108:
The memorandum must be signed by the party against whom the enforcement of the contract is being sought (usually the person who is being asked to fulfill the contract, typically the Vendee/Buyer).
Alternatively, the memorandum can also be signed by an authorized agent of the party, meaning someone legally designated to act on behalf of the person (such as an attorney or a legal representative).
How Does It Help?
A signed memorandum helps by:
1. Making the Agreement Enforceable: If the contract falls under the statute of frauds (which applies to certain types of contracts, like those for the sale of land or contracts that cannot be performed within one year), the memorandum provides the written evidence required to enforce the agreement.
2. Preventing Fraud and Disputes: By requiring a signed writing, the statute of frauds and the memorandum provision protect against false claims of agreements that were never made. The signed document becomes legal proof that both parties were in agreement.

Beware, you cannot save the information you typed and change it later. It will be a PDF upon saving. So if you need corrections...you have to start all over!

I had worked for a couple of months sending things back and forth to the county and still had no success. I decided to use deeds.com and it was all done in a few hours. Such a relief! While I find this to be wrong and the county should work with property owners as well as they work with third parties, I was still grateful for this service.

TODD Form would not print surveyor degrees character (superscript "o") in Exhibit A. It also would not print the "Return Address" or "Prepared By" entries with my middle name as your example showed.

EZ to use program....was able to print all forms ordered. I expect to go back to to use recording ability. Instructions are easily followed...would be nice to have confirmation included but they are available to purchase. Hope for successful recording of TOD affidavit. Very Poor and useles, a scam, don't waste your money, those templates are useless and do Not give you Any valid,proper, meeningful wording to use, did Not Help me, nothing more than what a 5th grader can come up with as far as wording or example..I feel I was riped off and this is a total scam... nothing useful
