Releasing a Mechanic's Lien in New Hampshire

Mechanic's liens are governed by Chapter 447 of the New Hampshire Statutes.

Use a lien release form when a filed mechanic's lien is no longer needed because the underlying obligation has been paid off, the claim has been settled between the parties, or for any other valid reason.

The lien created by RSA 447:2-7, inclusive, shall continue for 120 days after the services are performed, or the materials, supplies or other things are furnished, unless payment is previously made, and shall take precedence of all prior claims except liens on account of taxes. NH RSA 447:9. Therefore, the release can be used to officially cancel a lien after the expiration of time. Any compelled release will not be recognized unless it was made in consideration of payment on the underlying claim.

In addition to meeting all local standards for recorded documents, the lien release identifies the parties, the location of the work, recording information for the filed lien, and relevant dates and amounts. Once completed and notarized, the claimant submits the release form to the same office where the lien is on file.

You had the generic document that I was looking for Yay! The "example" page was helpful and reassuring. The auto input sections of my document looked ok until i printed it and then it appeared to be out of alignment which is why my rating is lowered to 4 stars it would be nice to have the ability to correct the title (created by me) when downloading PDFs for an e-filing

Very good information. Easy access and easy to download. All the forms needed for TOD to be notarized and recorded with the county office. Much better than working with a Trust and the expense of lawyers, especially when several parties are involved and the owner of said property knows exactly to whom the property should go. Having forms and instructions available for the public to have their wishes recorded and confirmed makes handling final planning much easier and prevents family members from having the unnecessary task of going through court to solve property distribution issues. Your documents were very helpful. I went ahead and filled in all the info for the Release of Lien document. It was easy to do with your example. I had all the necessary info such as plot numbers, etc. for the property and everything fit nicely onto the document. It has been notorized and mailed.
