Partial Release documents are guided by North Carolina Statutes 45-36.22
A partial release document for a Deed of Trust must do all the following:
1. State the Deed of Trust it is releasing, original parties to the Deed of Trust, recording data for the Deed of Trust (Book and Page number) and the office in which the Deed of Trust was recorded.
2. That (if the security instrument is a deed of trust, that the person or persons signing the partial release is or are the secured creditor, the trustee, or both the secured creditor and the trustee.) 45-36.22(2)
This Deed of Partial Release is formatted to be used by the secured creditor only, meaning the lender signs the document without the trustee and states:
TO HAVE AND TO HOLD said Released Property, together with all privileges and appurtenances thereunto belonging, to the Owner, its successors and assigns, free and discharged from the lien and operation of the Deed of Trust But it is agreed that this Release shall apply only to Released Property and as to the remainder of the property described in the Deed of Trust (not heretofore released), the Deed of Trust shall remain in full force and effect.

It was more detailed than the forms on other website, plus cheaper. I do not have date it was recorded in 2000 but did have date of warranty deed. Will that be ok with Recorder? Also did not want to date it today till I know when and where the Recorders office is located.

This was easy to use and only contained one glaring error-where to send the completed form to finish the process. I’ve completed the form, does this mean I get the amended deed sent to me? I think not.

You form was good the only thing that did not work was the download to fill it out !!! I use a Mac system and maybe that's what the issue was. I filled it out by hand and it worked for the purpose .

Great to have a downloadable form, rather than a cloud solution that gives no guarantee of privacy. Appreciated the sample.......but all of that still left me with open issues about how to tweak the form to serve my particular needs......for example: how to ensure that survivor rights were properly characterized; how far back I should go with the "Source" section + how I should layer my own additions to the chain of ownership, etc. Nonetheless, an overall happy experience. Outstanding. There is nothing worse than finding the correct forms or having to hire an atty to do what most people can do on their own. I cant speak for all but these forms are fairly easy. First time using Deeds.com and feel that your platform is clear and easy to use. I was also pleased with the messaging center and follow-up and also surprised at how quickly our particular deed was recorded and available to view. Having said that, when I first investigated Deeds.com the fee was $15 and as of 1/1/21 it has increased to $19 which I feel is pretty steep for the handling of 1 simple document especially when the turnaround was basically the same day. Your fee was nearly the equivalent of the cost of the Clerk's recording fee. Perhaps you should offer a fee schedule for those of us who are not volume recorders. Just a thought.
