Discharging Lis Pendens in Ohio
Lis pendens, Latin for "suit pending," is written notice that a lawsuit has been filed which concerns the title to, or interest in, a specific parcel of real property. The notice alerts potential lenders or buyers that the title to the property has come into question because of the pending legal action.
Ohio's statutes do not provide much guidance regarding lis pendens. Sections 2703.26-27 of the Ohio Revised Code discuss recording locations for the notice and restrict property transfers while the title is subject to lawsuit. Section 5309.58 clarifies the same details for registered land.
Once a lis pendens is filed, what about removing it? The process varies by state, but in general, removal happens one of two ways: expungement (removal) or discharge. Expungement requires a judicial directive to cancel the notice. The judge's order gets recorded, according to state and local requirements, and anything else necessary for the specific situation. For discharge, the party who filed the original notice completes and records a document that officially withdraws the complaint.
The discharge form identifies the parties, the property subject to lawsuit, court details and case number, and any other information relevant to the specific situation. Because it gets entered into the property records, the form should meet state and local recording standards.

I took a chance and downloaded the Beneficiary Deed form -- would have liked to have been able to see the form before I paid, but I took a chance as everywhere else I looked online wanted me to fill out form online and then pay $30+ for each deed. The Quit Claim Deed for the state of Ohio worked for me, saving me the cost of an attorney doing it. O.K., maybe that wouldn't have amounted to more than a few hundred dollars, but anywhere I thought I could save money (and learn something new on top of it) is something I want to do. That said, be forwarned. While I'm not an attorney I'm not averse to spending many hours researching the lingo found in this kind of form and thoroughly understanding exactly how everything has to be filled in. I should add that my ex-wife and I remain friends and she was the one giving me the property/house (thus, technically I filled out the forms on her behalf). Because there was no personal conflict, it made it easier to undertake. Lastly, what others have said about the county office where you must file a Quit Claim Deed not being helpful, that's true in the sense that they do not want to be instructing non-attorneys on filling out the necessary forms. I did take a preliminary draft set of the forms to the county office but was VERY CAREFUL about explaining that I only needed a couple of questions answered about procedure for submitting the final documents. They were helpful once I made it clear I wasn't asking them for "legal advice". And their help was critical as the final submittals requires stopping at three different offices (MapDocuments, Auditor and finally the Recorder's office). So I say thank you to Deeds.com. Their service for the Quit Claim Deed was invaluable.
