When filing a case affecting title to real property or at any time after, as long as the case is pending, any party to the suit may file a Pendency of Action. To be effective it must be recorded at the Recorder of Deeds/ Clerks Office in every county where said property is located. (The notice shall be recorded in the same book and in the same manner in which mortgages are recorded.) From the time of recording, the Notice of Pendency, becomes constructive notice to would be purchasers or encumbrancers. Such Notice will contain (the names of the parties, the object of the suit, and the description of the real property in the county involved, affected, or brought in question, signed by the party or the attorney of the party.) Get Rid of the places to initial each page on the Trust Deed. The Co. Recorder (Davis) does not require that each page be initialled... If I and the "borrower" had initialed each page, then I would have to use US Mail to get the form from AZ to UT because scans of initials are not acceptable, but only a notarized signature from the borrower is...

Very good information. Easy access and easy to download. All the forms needed for TOD to be notarized and recorded with the county office. Much better than working with a Trust and the expense of lawyers, especially when several parties are involved and the owner of said property knows exactly to whom the property should go. Having forms and instructions available for the public to have their wishes recorded and confirmed makes handling final planning much easier and prevents family members from having the unnecessary task of going through court to solve property distribution issues. Thank you for this site and the forms you provide. I will recommend Deeds.com to those I know who are making final plans.
