As a Pennsylvania property owner, should I file a Notice of Commencement?

Mechanic's Liens are governed by Title 49 of the Pennsylvania Consolidated Statutes.

In Pennsylvania, an owner may file an OPTIONAL Notice of Commencement with the Directory of General Services (DGS) registry. The purpose of filing the Notice of Commencement is to provide all the relevant information necessary for a subcontractor or supplier to file a Notice of Furnishing. 501.3.

Prior to the commencement of labor or the furnishing of materials for a searchable project that may give rise to a mechanics' lien under the mechanic's lien code, the searchable project owner or agent of the searchable project owner may file a Notice of Commencement with the directory. 501.3(a)(1). The contractor can also act as the owner's agent and file the Notice of Commencement if the contract provides. 501.3(a)(2).

Filing a Notice of Commencement triggers the requirement for a subcontractor or supplier on the job to serve you with a Notice of Furnishing within 45 days. 501.3(b)(1).

Section 501.3(a)(3) states that the Notice of Commencement must include the following information:
1) Name, street address, and e-mail address of the general contractor.
2) Name and location of the project.
3) County in which the project is located.
4) Legal description of the property, including all its tax-parcel identifying numbers.
5) Name, address, and e-mail address of the owner of the property and (if different) of the project.
6) If applicable, the name, address, and e-mail address of a surety for performance and payment bonds.

Upon receipt of a Notice of Commencement, the Directory will assign a unique identifying notice to it. 501.1(e)(1). Additionally, the Notice must be posted at the worksite and the owner must take reasonable steps during construction to ensure the notice remains posted and available for view. 501.3(a)(4). The project owner and contractor must also make reasonable efforts to ensure that a copy of the Notice of Commencement is included in all contract documents that are provided to subcontractors who awarded work on the project. 501.3(a)(5).

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

the deed format and fill-in language are very specific to one type of easement and are not generally applicable to any other type; in other words it is not useful in a majority of situations and i would recommend against purchase unless you are creating an easement for an appurtenant landowner ONLY

Best Way EVER to record a warranty deed! It was nice to not have to drive anywhere and find the facility closed or "unable to process due to covid19 and buildings being closed". The correspondence between me and deeds.com was very timely in our back and forth email correspondence, and the processing was all finished in a timely manner. Totally worth the extra $15 that I paid in addition to the recording fee. I would use this again and again. My time and the efficiency of the job completed is worth the money.

I am generally pleased with your products. However, I found it difficult to return to the package after accessing one selected document. One other comment: Your Trustee's Deed package should include a Certificate of Trust form.
