The certificate of trust is codified at T.C.A. 35-15-1013 as part of the Tennessee Uniform Trust Code. The purpose of the certificate is "to evidence the existence and validity of the trust" (35-15-1013(a)). The document contains sworn statements made "by the trustee or trustees having signatory authority as identified" within the document (35-15-1013(a)). The recipient of a certificate of trust may rely on the statements made within as factual without additional inquiry (35-15-1013(d)).
Instead of furnishing the trust document, a trustee may present a certificate of trust to third parties when doing business on behalf of the trust. The certificate is a condensed summary of the trust and its provisions, and allows the settlor's estate plans, including the identities of trust beneficiaries, to remain private.
A certificate of trust contains statements that the trust exists and that it "has not been revoked, modified or amended in any manner that would cause" the information in the certificate to be incorrect. The document recites the name and date of trust, the settlor, trustee, and relevant powers of the trustee to conduct the business for which the certificate is presented.
If there is a successor trustee, the document details the conditions of their succession. Certificates for trusts with multiple trustees define how many trustees are required to jointly act to conduct trustee powers. If the trust is revocable, the form includes the name of anyone with a power to revoke the trust. Finally, it presents the name by which the trust holds title to assets and, if necessary for the transaction for which the certificate is given, the trust's identification number.
If recorded to facilitate acquisitions or transfers of real property, a certificate of trust should include the legal description of the property subject to the transfer. The document must meet requirements for recording in Tennessee before submitted in the register of deeds in the appropriate county.
The protections under 35-15-1013 for persons dealing with trustees are not dependent on receipt of a certificate.

As a Title / Petroleum Land Professional (Landman), I use a wide variert of online title research tools and services. Mist are EXTREMELY COMPREHENSIVE, and relatively easy to perform one’s research. I am beginning to beliece that there is no search intrrfaxe here; just a long list of instructions full of circular references that simply tuns the researcher around and around to the same pages repeatedly. This service takes users NOWHERE. Good luck to those seeking to waste their time reading a vast set of redundant words and NO INTERFACE FOR CREATING OR EXECUTING AN AXTUAL SEARCH.

We aimed to handle a survivorship affidavit (deed change) without a lawyer following my dad's death. After some searching, deeds.com seemed to have the most comprehensive and "correct looking" form we could find for our locale, so we went with it, and it was accepted by our recorder's office. I'm not sure why our local government office doesn't offer a standard form, but they don't, and deeds.com came through for us in a pinch.

The deed is presently at the auditors office and will be recorded after approval from zoning board. As far as I know, everything is going along well. A self addressed envelope was left at recorder's office for return after recording is complete.

Ordered quitclaim deed form for Knox county Illinois. It got the job done however it was not a very good format. I had to explain all to the county recorder & was worried she would reject it. I would not recommend this item.

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

Ordered the forms I needed for my state and county and everything worked out perfectly. All the forms came with examples (filled in) and very detailed instructions for each block that required an entry. I was able to fill everything out on my computer and save the files for future use, if required. Deeds provides an excellent product.
