The Recorder is responsible for maintaining real property records in Koochiching County.

Recording Fees

To record any document, the fee is $46.

The multiple filing fee for satisfactions, partial release, and assignments is $10 per document listed after four.

A plat filing is $56.

Fees for Torren's documents are the same as above. Additional fees will be collected for multiple certificate entries, Residue Certificates, Exchange Certificates, CECT Plats, Amendments, etc.

A $50 fee is required to file a well certificate.

Deed tax is calculated on the purchase price of the property, less any assumed mortgages and special assessments and taxes included in the purchase price. The rate of tax is $1.65 for each $500 of purchase price.
Deed tax = Sale amount x .0033

For deeds and mortgages being recorded, the Auditor's/Treasurer's Office will collect a separate check for state deed tax and mortgage registration tax. Visit the Koochiching County Recorder's website for more details.

Document Formatting Requirements

* A document consists of one or more individual sheets of 20 pound weight white paper measuring no larger than 8.5 x 14 inches.

* Printing or typing should be in black ink, with a minimum font size of 8 point.

* The top of the first page should have a blank margin of 3 inches. The right half of this will be used by the County Recorder for recording information or the Registrar of Titles for filing. The left half of this margin will be used by the County Auditor or Treasurer for certification. All other margins should be at least .5 of an inch.

* Below the 3-inch top margin, a document title should be prominently displayed.

* No additional sheet shall be attached or affixed to a page that covers up any information or printed part of the form.

* A document must be sufficiently legible in order to be reproduced using Koochiching County's current method of reproduction.

REQUIRED INFORMATION

* If the owner of property is married, no conveyance of the homestead shall be valid without the signatures of both spouses, except for exempt transactions. A spouse's signature may be made by the spouse's duly appointed attorney-in-fact.

* Deeds must include the name and address of the person who prepared the instrument. The name must be typed, stamped, or printed in a legible manner. This statement can be given in the following form: "This instrument was drafted by NAME and ADDRESS."

* The name and address of the person to whom future tax statements should be sent must be included with the deed, if applicable. This can be given in the following form: "Tax statements for the real property described in this instrument should be sent to LEGAL NAME OF GRANTEE and RESIDENTIAL OR BUSINESS ADDRESS."

* A county recorder or registrar of titles shall accept a document for recording that is not prepared in the English language but is otherwise recordable, if there is appended to the non-English language document an English translation of the document and a certificate of translation.

THE NEW eCRV: As of October 2014, transfer deeds require submission of an electronic Certificate of Real Estate Value (CRV).
* Submitters fill in the online eCRV form and receive an eCRV ID number.
* They must reference this eCRV ID number when presenting the deed to the county.
* Counties view eCRV data online, verify, and add additional information. They may also download or upload data as needed.
* Paper copies are no longer accepted.

WELL DISCLOSURE CERTIFICATE: Prior to signing an agreement to sell or transfer real property, the seller must always disclose in writing (well disclosure statement) the location and status of all wells on the property to the buyer, along with the legal description and county of the property, and a sketch map showing the location of each well or indicate there are no wells on the property.

A Well Disclosure Certificate form can be obtained under supplemental forms on this site or from the Minnesota Department of Health website; it can be filed electronically or in person. The certificate number must be stated on the transfer document.
