Document Formatting Requirements

Ohio has recorded land as well as registered land. Both types of documents can be brought to the County Recorder.

A deed should be signed and acknowledged by the grantor. The county recorder is not authorized to take acknowledgments.

If signatures in the document are not legible, the recorder cannot accept the instrument unless corresponding names are legibly printed, typewritten, or stamped beneath the signatures.

The name of the person who prepared the instrument should be typewritten, printed, or stamped legibly at the end of the instrument. This requirement will be met if a statement in the following form is used: "This instrument was prepared by (name)."

Use white paper that is either 8.5 x 11 inches or 8.5 x 14 inches in size. If size and legibility requirements are not met, the person submitting the document may be asked to submit the original (if submitting an illegible copy) or to submit a true copy in order to satisfy requirements.

If an instrument is executed in whole or in part in a language other than English, it must be accompanied by a certified English translation, as defined in the Ohio Revised Code, section 317.113.

Use a legible font in a size of at least 10 point. Text should be in black or blue ink Highlighting is not permitted. The Ohio Recorders' Association suggests Helvetica font, Times New Roman, or Palatino.

At the top of the first page, provide a 3-inch margin to accommodate the certification or endorsement by the county auditor, county engineer, or county recorder. The right half of the 3-inch top margin is reserved for the county recorder.

At the top of each remaining page, provide a 1.5 inch margin to accommodate the certification or endorsement by the county auditor, county engineer, or county recorder.

All other margins should be at least 1-inch on each side of the page and on the bottom.

The county recorder will not accept a document unless it bears the stamp of the county auditor stating that the conveyance has been examined and that the grantor has complied with section 319.202 of the Ohio Revised Code. When the conveyance is presented to the county auditor, it will be marked as "transfer not necessary" or "transferred."

A recorded grant should include a reference by volume and page to the record of the deed or other recorded instrument under which the grantor claims title, but the omission of the reference will not affect the validity.

Whenever a survey is made of lands that are being conveyed, the county auditor will require that the name of the person who made the survey appear in the deed. The name should be printed, typewritten, or stamped legibly. This requirement will be met if a statement in substantially the following form appears on the deed: "A survey of this property was made by..."

The statutory form for a deed calls for the preparer of the document to list the marital status of the grantor.

Include the grantee's mailing address in a document of conveyance.

Provide a legal description of the real property being conveyed.
