The County Clerk is responsible for recording and maintaining records related to real property situated in Fremont County.

Public Records - The following types of property records are recorded and made a public record in Fremont County:
1. Real Property records such as deeds, leases, mortgages and contracts.
2. Subdivision records such as plats, subdivision permits, and covenants.
3. Maps of Surveys which are not subdivisions.
4. Land Survey Corner Records
5. Mining Claims

Recording Fees

As per Wyoming Statute 18-3-402 (XVI), effective July 1, 2013:

To record the first page of a document, the fee is $12. Each additional page is $3.

For an instrument with more than 5 grantors or grantees of a different surname, a $1 fee will apply to each additional name.

For each section, lot, block, or tract in excess of 10, a $1 fee will apply to each additional description.

For any instrument containing more than 2 real estate descriptions by book and page, there is a $2 fee for each additional reference.

A county clerk may charge a reasonable fee for a copy or a reproduction of a public record, but the fee shall not exceed the actual cost of duplication of the record. As used in this subsection, “actual cost of duplication” means the cost of materials and supplies used to duplicate or reproduce the record, but shall not include the cost of labor or the overhead associated with the duplication.

Document Formatting Requirements

- Documents must be originals. A copy cannot be recorded. The entire document must be clearly readable and reproducible.

- All documents must be acknowledged (notarized) in accordance with Wyoming law.

- When recording a warranty deed, quit claim deed, notice of sale, contract for deed, or any other instrument used to transfer land, Fremont County requests a "Fremont County Land Division Affidavit". This form will not be recorded with your document and is offered in an educational effort to expand knowledge of the subdivision laws of the state and county.

- Corresponding names must be printed or typed underneath all signatures except for notaries and witnesses.

- Provide a blank 2-inch margin at the top of the first page and at the top or bottom of each subsequent page. This area is reserved for recording purposes. All other margins should be at least 1 inch.

- The document title should indicate the type of document that is being recorded. The title can be given after the 3-inch top margin.

-Documents needing to be abstracted must have a valid legal description. If a document does not have a legal description, it can still be recorded but will not be abstracted in the tract indexes.

- The Recorder may record any deed that contains a metes and bounds description which may be accompanied by a map prepared in compliance with law and delineating the land described in the deed. If a map delineating the land has already been recorded, the deed may make reference to the recorded map. The County Clerk shall charge $2 for recording these maps.

STATEMENT OF CONSIDERATION

A Wyoming Statement of Consideration must accompany real property documents submitted to the County Recorder. This statement discloses the financial information of the transaction and must accompany any transfer of land by deed.
This form is for the Assessor's office to determine market value of all property in the county and is not recorded. Submit three copies of the form with your deed.

If an exemption applies, the statement is not required to be submitted. However, the submission of the statement, completed through Part C with a signature under Part E, may avoid the necessity of the County Assessor contacting the buyer (or buyer's agent) to confirm applicability of an exemption. If you choose to submit a statement for an exempt transaction, indicate which exemption applies.

COUNTY AFFIDAVIT
