When real estate in California is owned by joint tenants and one of the owners dies, the remaining owner(s) can clear the title by recording an affidavit of Death of a Joint Tenant.
Joint tenancy is a way for two or more people to own property in equal shares so that when one of the joint tenants dies, the property can pass to the surviving joint tenant(s) without having to go through probate court.
The affidavit should be recorded in order to be binding on others. Take a certified copy of the death certificate of the deceased joint tenant and your affidavit to the recorder's office in the county where the real property is located.

The information and instructions provided is thorough and great. But, the fill-in-the-blanks form does not work well and is very frustrating. The font size of the information I was adding on each individual line varies and is determined by the number of characters entered on that individual line. So the font size is different on each line. And the number of lines is fixed making it impossible to fill in the full legal name of the trust I needed to fill out the form for. My needs are somewhat unusual, but the form should have been designed to be flexible enough to handle it. A blank paper form would have been more useful.

Very good information. Easy access and easy to download. All the forms needed for TOD to be notarized and recorded with the county office. Much better than working with a Trust and the expense of lawyers, especially when several parties are involved and the owner of said property knows exactly to whom the property should go. Having forms and instructions available for the public to have their wishes recorded and confirmed makes handling final planning much easier and prevents family members from having the unnecessary task of going through court to solve property distribution issues. The release of mortgage form was OK, and accepted at the recorder's office, but there were some problems. Many of the fields to type in were too small to accept the data, and I could not find a way to change the field size or use a smaller font. Otherwise I was satisfied.
