Personal representative's deeds are used to transfer real property from both testate (with a will) and intestate (without a will) estates. These documents provide essential information about the specific probate estate and related property transfer in one document.

When a person dies, the probate court authorizes someone to take responsibility for distributing the remaining assets according to the instructions set out in the decedent's will (if one exists), while also following state and local laws. This person is often known as an executor or an administrator of the estate. California, however, identifies the individual who accepts that fiduciary duty as a personal representative (PR).

One common task involves transferring title on the decedent's real estate. Deeds used for this purpose must meet the same state and local requirements as warranty or quitclaim deeds. They also include other details, such as facts about the deceased property owner, the probate case, and anything else deemed necessary by the situation. In addition, the PR must file a PCOR with the county assessor's office when recording the completed deed.

Note that these deeds may need to be recorded with the probate court as well as the county recording office. Consult with the legal professional involved in managing the specific probate case to ensure that all recording and notice requirements are met.

The process was easy going. The process is one thing, the results another. I have attempting to resolve this matter, of claiming sole ownership of the property for several YEARS. I lost my Bride of 65 years in 2015. A lawyer I hired failed in his attempt, so I'm waiting to see the actual results. Downloaded and used the Ladybird Warranty Deed for a county in Florida with no issues. Cost for the download and subsequent recording fee of the deed totaled less than $40. No reason to pay hundreds. I assume the subsequent transfer upon death will go smoothly, but I of course, will never know. The "example" of a completed form was very beneficial. Also, get a copy of the current deed and make sure legal description of real estate is exactly the same on the new deed.

I purchased the Notice of Completion form because the City of Chula Vista did not have a "fillable" version of this form on their website. The Deeds.com version of this form is somewhat different than the City's version (8 numbered paragraphs vs. 11 numbered paragraphs.) However, it contains the same information in a different format. This form provided more blank space to fill in important items- like a long ownership name- than the version on the City's website. The recorder's office was satisfied with this form as I hand-delivered it to the Recorder's Office and they approved it for recording. Overall, I found this form easy to use and found the extra blank space for writing on the form helpful. My one comment for possible improvement is: it would be even more helpful (particularly for attorney users) to have strike-out capability. I would have liked having the ability to strike-out inapplicable portions of long awkward sentences. Still, I would use this form again.
