Most Hawaii deeds hand over everything the signer holds. This one keeps the years. One individual grantor quitclaims a described parcel to a named grantee and, in the same sentence, reserves a life estate, so possession stays with the grantor for life while the grantee holds a remainder interest from delivery forward. This Hawaii Quitclaim Deed (Reserving Life Estate) is a fillable form drafted for that movement of title.

Two owners, one at a time

A life estate deed divides a parcel along time rather than into shares. The grantor becomes the life tenant, holding the present possessory estate; the grantee becomes the remainder holder, often called the remainderman, holding a present interest that turns possessory only when the reserved life estate ends. Only one may occupy the land. The operative section states both halves in express words, the only way a Hawaii deed can: the state prints no statutory short form deed, so the estate comes from the instrument's own language. Title assurance is absent by design, as in any quit claim deed, and a mortgage of record keeps running against the whole parcel rather than dividing when the estate does.

The signature that cannot be taken back alone

Lifetime possession comes at a price the record makes permanent. Because a remainder is a present interest from delivery forward, the grantor acting alone cannot cancel it, redirect it by a later will, or sell the entire fee without the remainder holder signing too. Hawaii's revocable route is a separate instrument, the transfer on death deed authorized by chapter 527 of the Hawaii Revised Statutes, which moves nothing during life and stays revocable; it is recorded on its own and is not part of this package.

One grantor, one grantee, one certificate

The form recites one grantor, a natural person signing in an individual capacity above a printed name line, under one acknowledgment certificate that carries the substance section 502-42 prescribes along with the four entries a Hawaii notary completes: the judicial circuit of the commission, the document date, a description of the document, and the page count. The grantee takes the remainder and signs nothing. An owner conveying the whole fee, two record owners conveying together, a trustee, an entity acting through an officer or member, and an agent under a recorded power of attorney each recite authority differently, and this form is none of them; neither is a life estate measured by another person's life. Two configurations present the pattern this deed recites: an owner who intends to stay in the house for life while the remainder moves to one adult child, and an owner placing the remainder in an inherited parcel while keeping its use.

Registered land reads a reservation closely

One office, the Bureau of Conveyances in Honolulu, takes every Hawaii instrument, and its two systems part ways over this deed. In the Regular System, recording gives notice and fixes priority. Under the Land Court, section 501-103 provides that no new certificate is entered upon a transfer of registered land that does not divest the title in fee simple from the registered owner. A deed handing over a remainder while keeping a life estate sits on that line, and section 501-104 is written for lines like it: a question the assistant registrar doubts is referred to the court. Section 1 collects the tax map key, the recording system, and the certificate of title number section 501-108 requires in the body.

A remainder is still an interest for the tax

Hawaii's conveyance tax reaches a transfer of realty or any interest in it, so a remainder is inside it, measured by the actual and full consideration. Section 247-3 exempts a nominal consideration document between parent and child, or between spouses or reciprocal beneficiaries, and separately a document for one hundred dollars or less. Form P-64B claims an exemption and Form P-64A reports a price; depending on the transaction, the exemption form goes to the state tax department for approval or straight to the recording desk. The tax falls on the party conveying, and neither certificate belongs to this package.

I thought the website was good. But once I paid the money and downloaded the papers I needed for Grays Harbor. I had to end up calling a escrow company that we had worked with only to find out that they work with a slightly different version. The escrow company was kind enough to email me the version Grays Harbor recommends and uses. There is a chance I could use theses in the future.
