This form serves as notice that the Seller has agreed to sell, and Buyer has agreed to buy a specific property. Record this instrument when a Contract for Deed, Land Contract or Buy-Sell Purchase Agreement has been completed. This is done for a variety of reasons.

When parties want the details of a contract to be kept private.

When the Seller doesn't record the original Contract, very important for the Buyer to record a Memorandum of Contract. It serves as notice that the buyer is in fact purchasing the property, providing protection from further liens or encumbrances being placed on the property by the Seller. Memorandums are frequently recorded by buyers alone.

When owner financing is involved, and a buyer needs to finance property at a later point in time, a Lending Institution will most likely require a recorded Memorandum document. Further, banks like to see a history of payments, at least 12 months, often referred to as "Seasoning" a recorded Memorandum proves the subject property was under contract at a specific time.

It was convenient to be able to download the deed template, instructions, and a completed sample deed all from deeds.com. I was able to complete my deed with little effort. My only complaint is that the editable fields in the pdf document are of fixed size, leaving some large spaces within a sentence, for example: Executed on this 1st day of July ,2020. This makes the printed document look a little peculiar.

Site is easy to navigate and forms are as described. Too bad there is no secure payment link service (PayPal, Apple Pay, etc. So after I verify charge has hit my credit card I will delete my Deeds.com account.

The experience was generally very satisfactory. I was able to fill out the Trust Deed and send it via email no problem. However, I was not able to send the filled out form of the Note. It always erased my fill-ins when it was sent. I found that very frustrating.

Thank you, Gordon. Glad the Trust Deed worked well. Issues like the one you reported with the Note can sometimes be related to how the file is opened or sent. Using Adobe Reader to fill, save, and send the form is recommended. We also pass along all feedback like this to our team to confirm there are no issues.

Very helpful, with blank and sample completed documents. The only thing I was confused about was the "legal description" of my property. The documents weren't too helpful on what that meant. Otherwise they were great. It saved me $200 to prepare these myself.
