Typical Stated Reasons to Release a Memorandum of Contract:
Termination of the Purchase and Sale Agreement - The parties have mutually agreed to terminate the Purchase and Sale Agreement.
Expiration of Contract Terms - The Purchase and Sale Agreement referenced in the Memorandum has expired by its own terms and is no longer in effect.
Failure to Satisfy Contingencies - The agreement was contingent upon financing, inspection, or permitting, which was not obtained; thus the contract is void and the Memorandum is released.
Voluntary Release by the Buyer - The buyer no longer claims any interest in the property and voluntarily releases the recorded Memorandum.
Mutual Release of Claims - The parties have resolved all matters related to the agreement and consent to the release of the Memorandum.
Court Order (less common) - Pursuant to the order of the [Court Name], docket number [#], the Memorandum is released.
