Removing a Deceased Joint Tenant from a Washington Real Estate Title
Washington's statutes define joint tenancy at RCW 64.28.010. This law states that "joint tenancy with right of survivorship permits property to pass to the survivor without the cost or delay of probate proceedings." Property titled this way is not passed in a will; instead, a deceased joint tenant's share is distributed equally amongst the survivors as a function of law until only one person holds the property in sole ownership.
While technically accurate, this description oversimplifies the situation. What happens when it's time to sell the property? Unless the local recording office cross-references death notices with real estate records, the deceased owner's name remains on the title. This inaccuracy can create confusion during a title search and slow down the transfer process. In addition, outdated information might interfere with property tax billing, possibly leading to fees and/or penalties.
The surviving owner(s) can prevent these potential issues with a simple step: when one joint tenant dies, the other(s) execute and record an affidavit of facts as to death with the local recording office. It is possible to address this at the time of sale, but it makes sense to handle it within a short time after the owner's death. This action keeps property records up-to-date, verifies interests and rights to the title, and ensures smoother transfers in the future.
Each circumstance is unique, so please contact an attorney with questions or for complex situations.

Very easy & efficient to use! I would have had to drive an hour to the county office. So glad this worked instead! You should advertise more....if I hadn't done research I would never have known about your service.

I was very pleased. It was the form I needed. I was getting discouraged by companies that wanted me to sign up for monthly payments just to get the one form I needed. I prefer your system of paying for what I get. Thank you so much!
Thank you for your feedback. We really appreciate it. Have a great day!

Used a form from this service. Best part about these forms is that they don't let you get in trouble by removing or changing things that should not be changed. It's easy to look at something and think why is this margin so big, why is this field so small and want to change it only to find out it is incredibly important. That's why they are the deed document pros.
Thank you for the thoughtful review! We're so glad to hear you found our forms reliable and well-structured. It’s true—what might look like an odd margin or a small field is often there for a very specific legal or recording reason. We’ve seen how small changes can lead to big headaches, which is why we design our documents to be both user-friendly and compliant with strict recording standards. We really appreciate you recognizing the care that goes into each one. Thanks again for choosing us!

Could not give me any deed history prior to 1986, when our company bought the property, so this was a bust.
Thank you for your feedback April. Have a great day.

Easy to use and able to individualize, which was important since I needed to print more than one doc. I just wish I had an option for a less expensive purchase - seemed like a lot for just a couple docs.
