StatewideClerk service charges may not exceed those specified in s. 28.24, except as provided in s. 28.345. Plats and condominium exhibits larger than 14 by 8 1/2 inches: first page 30.00, each additional page 15.00. Indexing each entry not recorded: 1.00. The recording fees shown are the s. 28.24(13) charge ($5 for the first page, $4 for each additional page) with the Public Records Modernization Trust Fund charge ($1 for the first page, $0.50 for each additional page) and the $4 per page court-related technology charge added in; court judgments and notices of lis pendens do not pay the last two.

Recording Plat/Map larger than 8 1/2" x 14": first page $35, each additional page $19.50. Lis Pendens: $5 for the first page and $4 for each additional page. Copies of instruments larger than 8 1/2 x 14: $5 per page. Recording Certificate of Discharge, Separation or Services of Veterans: no charge. Standard search of records: $2 per name for each year searched. Authenticated clerk certificates: $11 total.

Paying the office

Cash is accepted only in person. Credit cards (MasterCard, Visa, American Express, or Discover) are only accepted in person and have a daily limit of $5,000. Personal checks are not listed; checks from a title company, attorney, or mortgage are accepted.

Transfer tax

Documentary stamp tax on deeds. On each $100 of the consideration therefor the tax shall be 70 cents. The tax is collected when the document is recorded. (statewide, Fla. Stat. § 201.02(1)(a))

StatewideDocumentary stamp tax on mortgages, trust deeds, security agreements, or other evidences of indebtedness filed or recorded in Florida: 35 cents on each $100 or fraction thereof of the indebtedness or obligation evidenced (Fla. Stat. § 201.08(1)(b)). Nonrecurring intangible tax: 2 mills on each dollar of the just valuation of notes, bonds, and other obligations secured by mortgage, deed of trust, or other lien upon Florida real property (Fla. Stat. § 199.133). A county as defined by s. 125.011(1) may levy a discretionary surtax on documents taxable under s. 201.02, except documents involving only a single-family residence (Fla. Stat. § 201.031).

Surtax is required on transfers of interest in any real property other than a single-family residence, at the rate of .45 cents for each $100 of consideration or fractional part thereof (or $4.50 per $1,000) (Miami-Dade Code 29-7(D)).

StatewideA 3-inch by 3-inch space at the top right-hand corner on the first page and a 1-inch by 3-inch space at the top right-hand corner on each subsequent page are reserved for use by the clerk of the court.

StatewideThe name and post-office address of each person who executed the instrument and of each witness must be legibly printed, typewritten, or stamped on the instrument, and the name of any notary public or other officer taking acknowledgments must be printed beneath that officer's signature. The clerk may, in her or his discretion, accept an instrument with a name or address in another position if the connection is apparent. Section 695.26 does not apply to instruments executed before July 1, 1991, court decrees, orders, judgments, or writs, instruments executed, acknowledged, or proved outside Florida, wills, plats, or instruments prepared or executed by a public officer other than a notary public.

Deeds require two witnesses not related to the transaction. A mortgage must have a copy of the promissory note attached, or the amount of the note written on its face. A satisfaction, release, or assignment must give the book and page of the original mortgage. Where a document lacks the 3 x 3 inch space on the first page, a cover page must be attached and an additional recording fee paid for that page.

Notices of Commencement and Declarations of Domicile can be submitted directly through the Clerk's eRecording Web Service after registration. The office does not guarantee same-day recording of eRecorded documents. Documents must be original or court certified, and signed and notarized.
