The County Recorder is also the Registrar of Titles under the Torrens (or registered land) system. The Registrar of Titles, along with the Examiner of Titles must inspect presented documents to determine if they meet the legal requirements for a transfer.

Recording Fees

Abstract Department:
To record a document, the fee is $46.
Multiple satisfactions or assignments are $10 for each additional citation over four.

Torrens Department:
An original certificate of title or a document creating a new certificate is $46.
A registered land survey is $56.

Miscellaneous:
A Well Disclosure Certificate is $50.

Deed tax is calculated on the purchase price of the property, less any assumed mortgages and special assessments and taxes included in the purchase price. The rate of tax is $1.65 for each $500 of purchase price.
Deed tax = Sale amount x .0033

Document Formatting Requirements

* Documents must consist of individual pages measuring no larger than 8.5 x 14 inches. Paper should be white and at least 20 pound weight with no background color or images.

* The form of the document should be typed, printed, or computer generated in black ink with a minimum font size of 8 point.

* No additional sheets or attachments shall be affixed to a page that covers up any printed information.

* A county recorder can accept a document that is not in the English language if a translation is appended to the document, along with a certificate of translation. The certificate of translation can be found in the Minnesota Statutes, 507.46.

* The first page of the document should have a blank top margin of 3 inches. The right half of this is reserved for the county recorder and the left half is reserved for tax certification. A person submitting a document for recording may attach an administrative page before the first page of the document to accommodate this standard. The administrative page should contain the document title, document date, and if applicable, the grantor and grantee. It will be deemed part of the document when recorded.

* Subsequent margins should be at least .5 of an inch.

* Below the 3-inch margin on the first page, the title of the document should be prominently displayed.

* A name and address should be provided for both the grantor and the grantee.

* The consideration exchanged for the real property should be listed on the document.

* A legal description of the real property is required.

* The name and address of the person who prepared the instrument should be given. This can be done in the following form: "This instrument was drafted by NAME and ADDRESS."

* The name and address of the person to whom future tax statements should be sent should be typed, printed, or stamped legibly on the deed. This can be given in the following format: "Tax statements for the real property described in this instrument should be sent to (legal name of grantee, followed by residential or business address)." This should be the same as the name and address offered for the grantee.

THE NEW eCRV: As of October 2014, transfer deeds require submission of an electronic Certificate of Real Estate Value (CRV).
* Submitters fill in the online eCRV form and receive an eCRV ID number.
* They must reference this eCRV ID number when presenting the deed to the county.
* Counties view eCRV data online, verify, and add additional information. They may also download or upload data as needed.
* Paper copies are no longer accepted.

WELL DISCLOSURE CERTIFICATE: Prior to signing an agreement to sell or transfer real property, the seller must always disclose in writing (well disclosure statement) the location and status of all wells on the property to the buyer, along with the legal description and county of the property, and a sketch map showing the location of each well or indicate there are no wells on the property.

A Well Disclosure Certificate form can be obtained under supplemental forms on this site or from the Minnesota Department of Health website; it can be filed electronically or in person. The certificate number must be stated on the transfer document.
