Document Formatting Requirements

* Documents must be submitted on 20# white paper that is 8.5 x 11 inches in size. Individual pages of a document should not be bound together at the top, bottom, or sides.

* Printing or typing should be in black ink, with a minimum font size of 10 point. Printing should be single-sided only.

* Additional documents or other materials should not be physically attached to any page in the document.

* In the upper right corner of the first page, a blank space of at least 3 x 3 inches should be provided.

* Other margins should be at least 1 inch and should be absent of any writing or markings. The Churchill County Recorder suggests setting margins at 1.4 inches to avoid any problems.

* A legal description of the real property must be provided. If this description is in metes and bounds, the following information should be given: the type of document from which the legal description was obtained; the book, page, and document number; and the date it was recorded. The name and mailing address of the person who prepared the legal description should be listed as well.

* The mailing address of the grantee must be included in a deed. If there is no grantee, the address of the person requesting the recording should be provided.

* The assessor's parcel number should be provided in the top left corner of the first page. This is not intended to serve as a legal description of the real property.

* The recorder may not record a document unless it includes the name and address of the person to whom a statement of the taxes assessed on the real property should be sent.

* The grantor's signature must be acknowledged.

DECLARATION OF VALUE

A Declaration of Value form must accompany all real property documents. If an exemption to the transfer tax is claimed, it should be noted on the Declaration of Value.

The assessor's parcel number must match the information presented in the deed. A separate sheet may be attached for additional assessor's parcel numbers. The assessor's parcel number can be obtained from the Churchill County Assessor's website.

The full price of the property should be entered. The purchase price is the amount paid to be paid and consists of cash paid, loans assumed, new loans obtained, and the value of any personal property given.

The total amount of the taxable value or sales price of the property should be entered.

If only a portion of interest is being conveyed, compute the tax on the portion being transferred.

When an exemption is claimed, write the exemption number and complete sections 4a and b. A list of exemptions can be found on the assessor's webpage for Churchill County.

The signature area needs to be completed by at least one party to the document. It is preferred that both parties complete and sign the form as both grantor and grantee are jointly and severally responsible for payment of the transfer tax.
Both sides of the capacity area of the form need to be completed, even if only one party to the document signs the form.

The names and addresses listed in the form need to match the names and addresses listed in the deed.
