A Delaware transfer on death deed stays revocable for the owner's whole life, but once recorded, changing course takes another recorded instrument. The Delaware Transfer on Death Revocation prepares the instrument of revocation that 25 Del. C. Section 211 describes: a document signed by the owner who made the deed, expressly revoking a recorded transfer on death deed, and itself placed of record before the owner dies. A TOD deed revocation or beneficiary deed cancellation is the same instrument under another name.
Three conditions written into the statute
Delaware adopted the Uniform Real Property Transfer on Death Act in 2025 (85 Del. Laws c. 212, effective December 4, 2025), and Section 211 lists what an instrument of revocation must meet. It must be acknowledged by the transferor after the acknowledgment of the deed being revoked, so the notarial dates on the two documents tell the sequence. It must be recorded before the transferor's death in the recorder of deeds office of the county where the deed was recorded; a notarized revocation sitting in a drawer at the owner's death revokes nothing. And it must be witnessed by two individuals, in addition to notarization.
The Act closes two other doors. A recorded deed may not be revoked by a revocatory act on the document, so tearing up the owner's copy changes nothing of record (Section 211(c)), and the questions printed with the Act's optional deed form add that the deed may not be revoked by will.
One owner revoking, or all of the joint owners
Where a deed was made by more than one transferor, Section 211(b) splits the analysis. Revocation by one transferor does not affect the deed as to another transferor's interest, so a revocation signed by one of two tenants in common removes only that owner's undivided share. A deed made by joint owners, which under the Act means joint tenants and tenants by the entirety, is revoked only if all of the living joint owners revoke it, so a revocation of a deed made by spouses holding by the entireties carries both signatures. The form provides signature blocks and acknowledgment certificates for one or two owners, the second left blank when a single owner revokes.
What the revocation leaves in place
The revocation removes the beneficiary designation and nothing else. Title stays where it was, and at the owner's death the property passes by will, by intestacy, or under any later transfer on death deed recorded afterward. Mortgages and liens are untouched; the deed created no interest in the beneficiary during the owner's life (Section 212), and the revocation creates none. The Act names two further routes, each a separate instrument prepared and recorded on its own and not included in this package: a later transfer on death deed revoking the earlier one expressly or by inconsistency, and a lifetime deed conveying the property that expressly revokes the transfer on death deed (Section 211(a)(1)). The capacity required to revoke is will capacity (Section 208).
Recording a revocation in Delaware
A revocation conveys no real estate, so it falls outside the class of documents on which Delaware's realty transfer tax is imposed (30 Del. C. Section 5401(1)); ordinary recording fees apply. Two statewide acceptance gates still govern the first page: the county tax parcel number in a conspicuous place (9 Del. C. Section 9605(f)) and the words "prepared by" with the preparer's name and address (Section 9605(h)); the recorder may not accept an instrument affecting real property without them.
Recording in Delaware is county by county
Delaware has no statewide recording form. The recording statute delegates paper size, margins, type size, and first-page layout to each county recorder (9 Del. C. Section 9605(g)), and the three recorders have exercised that delegation differently, each publishing its own standards for the first-page reserve and the placement of the parcel number and prepared-by line. This product is therefore delivered as three county versions, one each for New Castle County, Kent County, and Sussex County, and the purchase delivers the version matching the buyer's recording county, laid out to that recorder's published standards. The recording county is the one where the transfer on death deed is recorded.
Each county version includes the fillable revocation form, a completed example filled in for a realistic fact pattern in that county, and a guide that walks through every section, the signing formalities, and the recording steps. These materials describe the form and the governing statutes in general terms; they are not legal advice.

Get Rid of the places to initial each page on the Trust Deed. The Co. Recorder (Davis) does not require that each page be initialled... If I and the "borrower" had initialed each page, then I would have to use US Mail to get the form from AZ to UT because scans of initials are not acceptable, but only a notarized signature from the borrower is...

Deeds.com was such a blessing in order for me to get something done that my lawyers could not get done. Transferring a mineral right from my deceased parents to me and my husband. The mineral company person I worked with went above and beyond helping me fill the paperwork out perfectly so that it had “right of survivorship” (and other things phrased properly) so that either my husband or I won’t have the issue I have had. Had it not been for deeds.com I don’t think I would have been able to complete this process. I hope anyone that ever needs something such as this learns about I deeds.com.
Thank you, Julia, for your kind and thoughtful review. We're truly honored to have played a role in helping you and your husband secure your mineral rights — especially after such a frustrating experience elsewhere. It’s great to hear that our team and resources were able to guide you through the process with clarity and care. Your words mean a lot to us, and we hope others in similar situations find the support they need through Deeds.com, just like you did. Wishing you continued peace of mind and security with your property.
