On this Hawaii deed both sides of the conveyance are married to each other: one spouse signs as the grantor, and the other spouse is the named grantee. The Hawaii Quitclaim Deed (Interspousal) is a fillable form built for that single movement of title, releasing whatever right, title, and interest one spouse holds in a described Hawaii parcel to the other, under one signature line, one acknowledgment certificate, and no covenant or warranty of title.

A conveyance the vesting statute names in its own words

Most vesting statutes describe who may hold title. Section 509-2(a) of the Hawaii Revised Statutes goes further: it lists the conveyances a person may make with no third party in the middle, and one item on that list is a conveyance by one tenant by the entirety to that tenant's spouse or reciprocal beneficiary of all of the tenant's interest. The rule has practical bite. An owner who cannot hand entireties property to an outsider without the other owner's signature may hand the whole of that interest to the other spouse alone, because the statute writes that route in. The conveyance clause on this form identifies that authority, which is one reason the deed reads differently from a form drafted for a sale.

A release, with no promise attached

What the deed assures about the title is nothing at all. A quitclaim deed, also written as a quit claim deed, remises, releases, and forever quitclaims the grantor's interest and states in the same section that no covenant or warranty of title is made. The clause carries whatever the signing spouse holds, whether sole record title or a share of a co-ownership with the receiving spouse. Because one grantee is named, the interest lands in the receiving spouse alone and no fresh co-ownership appears: a tenancy by the entirety or a joint tenancy takes the express designation Section 509-2 requires and two names in the grantee position, a pattern this form does not recite.

One signer, and the same names in the certificate

The grantor signs. The grantee spouse receives the interest and signs nothing, which holds the form to one signature block and one certificate. Both parties are still fully named: each entry carries a full legal name, a mailing address, and a marital status naming the other spouse, and the grantor's name reappears beneath the signature line and again inside the notary's certificate, where Hawaii's intake rules permit no discrepancy among the three. That discipline earns its keep here, since Land Court intake asks for the full name of a married person's spouse and a couple often enters one shared street address on both sides of the deed. The certificate collects the acknowledgment substance the recording chapter prescribes along with the items Hawaii's notary rules add: judicial circuit, document date, document description, and page count.

Nominal consideration and the tax certificate

No Hawaii conveyance is recorded until its conveyance tax question is answered, and a transfer between spouses usually answers it with an exemption rather than a payment. Section 247-3 exempts a document between husband and wife, or between reciprocal beneficiaries, in which only nominal consideration is paid, and separately exempts a document whose consideration is one hundred dollars or less. A conveyance made for real money reports the actual and full consideration and pays at the graduated rates instead. Either certificate is a Department of Taxation form, obtained and completed on its own, and neither is included here. On the deed, the consideration entry states the parties' own figure; the completed example states one dollar together with love and affection.

The inch below the registrars' band

Every Hawaii deed is presented at a single address, the Bureau of Conveyances in Honolulu, and page one of this form is laid out for what happens there. The top three and a half inches carry nothing at all, and the return information occupies the inch beneath that reserve, where an interspousal deed commonly names the grantee spouse at an address the deed has already recited twice.
