Questions answered? Let's get started!

A personal representative's deed is a fiduciary instrument executed by a personal representative (PR), who is appointed by the Probate and Family Court to administer a decedent's estate.

Use a deed of sale to convey title to a purchaser pursuant to a power of sale in the decedent's will and/or decree (license) following a petition of the court. A decree is required for all informally probated estates, regardless of the existence of a power of sale. Seek legal advice to ensure all prerequisites are met.

A PR deed conveys title with quitclaim covenants. The grantor of a PR deed warrants the title to the grantee against the lawful claims of persons claiming by, through, or under the grantor. Conveyances of title made by a PR to a purchaser for value are free from claims of general creditors and of legatees and devisees under the decedent's will, pursuant to REBA Title Standard No. 10.

The deed must meet the same standards for form and content as other instruments transferring title, and also contain details relating to the deceased owner. Depending on the situation, the PR might need to include additional supporting documents prior to recording.

Consult a lawyer with questions about Personal Representative's Deeds of Sale, or for any other issues related to probate proceedings in the Commonwealth of Massachusetts.

One of the most satisfactory and easy to use websites I have come across. Being able to record documents in the court records without having to pay an atty $500 per hour and accomplish the recording in about 24 hours instead of days and even weeks i s invaluable. Worked perfectly.

After my county rejected a deed from another company, I researched better and purchased my Lady Bird Deed from Deeds.com. Very simple, received everything immediately. Printed out sample and guide sheets and filled out my deed. Very thorough and easy to understand. All the additional forms were awesome. And the best part is, my county recorded my deed this morning! WooHoo! Very happy customer! Thank you!

Delivered as promised but the explanation of how to complete the form is very basic. I'd like to see a few broader explanations such as if the spouse isn't the affiant, etc.

Thank you, Regina. We’re glad the forms were delivered as promised, and we appreciate the suggestion. We’ll keep that feedback in mind as we continue improving our guides and examples.

I was very impressed with the quick responses I received from my questions. Usually when forced to communicate via email, responses aren't received right away. Thank you for being on top of things.
