When a Vermont mortgage held by two spouses or civil union partners has been paid in full, the record is cleared by a discharge that both holders execute. This Vermont Discharge of Mortgage form prepares that instrument: a separate acknowledgment of satisfaction under 27 V.S.A. Section 463, set up for exactly two mortgagees of record who are married to each other or are parties to a civil union.
One Mortgage, Two Holders of Record
The two-holder pattern this form recites usually begins with seller financing. A couple sells Vermont real property and takes back a mortgage from the buyer, and the recorded mortgage names both of them as mortgagees. Vermont treats a marital co-ownership interest as one that neither partner disposes of alone, and the state's title standards describe a discharge by separate instrument as executed and acknowledged by the mortgagee of record. Where two people are the mortgagees of record, the discharge that clears the record carries both signatures, and this form carries a signature line, a printed name line, and an acknowledgment certificate for each of them.
Civil union partners stand in the same position as spouses here: 15 V.S.A. Section 1204 grants parties to a civil union all the same benefits, protections, and responsibilities under Vermont law as spouses in a civil marriage, including the incidents of holding and transferring property.
Paid in Full and Satisfied: the Statutory Certification
Vermont writes the operative words itself. Under 27 V.S.A. Section 463, a mortgage may be discharged by an acknowledgment of satisfaction substantially in the statutory form: a certification that the described mortgage is paid in full and satisfied, identifying the mortgagor, the mortgagee, the date of the mortgage, and the book and page of the town land records where it is recorded. The form carries that wording, adapted to two certifying holders, and once the satisfaction is acknowledged before a notary public and recorded, the statute gives it full effect: it discharges the mortgage and bars actions brought on it.
The statute also sets the clock. Within 30 days after full performance of the mortgage conditions, 27 V.S.A. Section 464 directs the mortgagee of record to execute and deliver a valid and complete discharge, with statutory damages of $25.00 per day, up to an aggregate of $5,000.00, for a holder or servicer that lets the deadline pass.
Recording With the Town or City Clerk
Vermont records land instruments by municipality rather than by county, so the discharge, sometimes searched for as a satisfaction of mortgage, mortgage release, or lien release, is recorded with the clerk of the town or city where the mortgage itself is recorded. The statewide recording fee is $15.00 per page under 32 V.S.A. Section 1671, and because a discharge is not a transfer of title, no Vermont property transfer tax return accompanies it at the counter. The form reserves the top of its first page for the clerk's recording information and keeps every entry inside Vermont's recording page standards.
