Use this form to release a previously recoded mortgage when it is paid in full. (Any mortgage or deed of trust shall be discharged upon the record thereof, by the county clerk in whose custody it shall be, or in whose office it is recorded, when there shall be recorded in his office a certificate or deed of release executed by the mortgagee, trustee or beneficiary, his assignee or legally authorized representative, or by a title agent or title insurer acting in accordance with the provisions of W.S. 34-1-
145 through 34-1-150)(Wyoming Statute 34-1-130)

A lender/mortgagee generally has 30 days to release a Mortgage to avoid penalty.

((a) A mortgagee shall, within thirty (30) days after having received by certified or registered mail a request in writing for the discharge or release of a mortgage, execute and acknowledge a certificate or deed of discharge or release of the mortgage if there has been full performance of the condition of the mortgage and if there is no other written agreement between the mortgagee and mortgagor encumbering the property subject to the mortgage.

(b) A mortgagee who fails or refuses to discharge or release a mortgage within the thirty (30) day period required by subsection (a) of this section is liable to the mortgagor or his assignees for:

(i) All actual damages resulting from the mortgagee's failure or refusal to discharge or release the mortgage; and

(ii) Special damages in the amount of one-tenth of one percent (.10%) of the original principal amount of the mortgage for each additional day after the thirty (30) day period until the mortgage is released or discharged. Special damages authorized by this paragraph shall not exceed one hundred dollars ($100.00) per day.)(34-1-132. Liability of mortgagee for failing to discharge)

The purchasing process was very slick and my credit card was charged IMMEDIATELY. The deliver went well as the link was provided immediately. However I asked a question via the "Contact Us" link and days later I get a survey but no reply. I may have been directed to the wrong forms via my County and I wanted to confirm that...but still no answer. What would that deserve as a rating???

Your Personal Representative's Deed and example for the state of PA were extremely helpful. Exactly what I needed! Two feedback comments: 1. Valuation Factors/Short List in my download is an outdated table dated July 2020. The PA Dept of Revenue website has a more current table dated June 2021. (Maybe same for Valuation Factors/Long List, which I didn't use.) 2. Notarization section on deed page 3 has a gender-related input needed, which confused the Notary Public representative where I live in the state of CO. Notary input the word she to apply to my wife, but wasn't clear to him if the gender input applied to the Grantor or the Notary. He assumed Grantor. Also in our non-binary world, some might find that wording offensive. Thanks again for your documents. Russ Lewis
