Each city and town in Rhode Island has its own recording office for real property documents. Property records are not recorded by county.

Documents should be sent to the appropriate town or city relative to the property address. The Newport City Clerk is responsible for recording and maintaining only the land records for properties located in the city.

Recording Fees

The fee to record a warranty deed or a quit claim deed is $84 for the first page, and $1 for each additional page. A mortgage is $64 for the first page, and $1 for each additional page.

Document Formatting Requirements

* Documents submitted for recording must be originals or certified copies.

* A 2 x 2 inch space on the last page of the document and a 1 x 1 space at the top of each document must be provided for recording purposes.

* Deeds submitted for recording must reference the property address.

* To submit a timeshare deed to be recorded, it should be an original executed document containing original signatures.

* A timeshare deed must be notarized. If it has been notarized out of state, it should have a raised seal.

* Timeshare deeds must include the grantee's name and address.

* When there is no consideration, the timeshare deed should state: 'Consideration is such the No Documentary Stamps are required.'

* When a timeshare deed does have consideration, it is at the rate of $4.60 per thousand, rounded to the nearest $500.

* For a timeshare deed, a reference to the Rhode Island smoke detector law must be incorporated into the document; however, this statute does not apply to individual timeshare deeds.

* An assignment and discharge of mortgage must reference the mortgagor, the original mortgage book and page, and the property address.

* A reference to the Residency Affidavit (R.I.G.L. 44-30-71.) must be incorporated into the document.

* Deeds presented for recording must have listed the total dollar amount of the actual sale.
