Mechanic's liens are governed under Title 10, Chapter 603 of the Maine Code. A waiver is a forfeiture or "giving up" of a legal right. In this case, the person granting the waiver is giving up the right to seek a mechanic's lien for all or part of the amount due. This assurance is usually enough to get the other party to pay. The Maine Code does not set out statutory forms for waivers, but according to the principles of contract law, the parties may agree to such modifications in writing.
In general, there are four types of waivers: conditional or unconditional, and referring to a partial or final payment. Conditional waivers become effective when the payment is confirmed (paid) by the bank, and offer more protection for the contractor. Unconditional waivers go into effect immediately, regardless of whether or not the payment is confirmed, and offer more protection for the property owner. Partial, or progress payments relate to specific time frames or completed steps in the project. Final payment waivers apply when the responsible party pays the entire balance due.
Use the final unconditional waiver when a full and final payment is made and collectability of the due amount is not an issue. Only grant an unconditional waiver when payment is made through a verified method. The waiver is effective up to the full amount due and the claimant waives any lien rights without condition.
Lien waivers identify the parties, the location of the project, relevant dates, and amounts paid. Record the signed, notarized waiver in the local recording office, and deliver a certified copy of the recorded document to the property owner.

AMAZING! Easy to use, reasonable fee - and get MUCH MORE than just a deed form. I ordered a "deed" and received a whole "package," including a guide and the jurisdiction's costs schedule and cover page that would be needed to record the deed - even included a Certificate of Transfer that is not required for a deed but something I needed for a different transaction. The website was extremely easy to use and the cautions about not disclosing personal information were so clear and personal, they made me feel secure in knowing this site was not trying to rip me off. I thought the forms were reasonably priced, the instructions included in the packet were thorough, and the examples helpful. Thank you for the additional CDR forms too. I contacted the Recorder's office via email with a question and Jennifer Bowser answered promptly. Job well done! However, when I delivered the deed and Real Property Transfer Declaration to the Clerk's office in Lafayette, the clerk was unfamiliar with the Declaration document being submitted and it took some time to convince her to submit the form without charging the recording fee. She even tried to phone the recorder's office for clarification, but no one answered. There then was an additional form at that office that I had to complete called Recording Request/Transmittal Form. I would suggest including that form with instructions in your on-line packet to speed up the process when a Deed is delivered to the County Clerk's satellite office. I do not expect every clerk to know all the particulars of recording requirements but a little knowledge wouldn't hurt.
