Oregon's Construction Lien Law is codified at ORS 87.001 to 87.060 and 87.075 to 87.093.

Property owners and other interested parties who contract for construction work need to be vigilant and ensure that their property remains free from a mechanic's lien, especially those of any "hidden" lien claimants that may be working under another party and the owner is unaware. Therefore, an owner should draft, record, and post at a job site, a Notice of Completion, upon the jobs completion, because a lien must be perfected no later than 75 days after the project has ended or been abandoned.

In Oregon, a construction project is deemed complete when (a) the improvement is substantially complete; (b) a completion notice is posted and recorded; or (c) the improvement is abandoned. O.R.S. 87.045(1).

When all original contractors employed on the construction of the improvement have substantially performed their contracts, any original contractor, the owner or mortgagee, or an agent of any of them may post and record a completion notice. O.R.S. 87.045(2). The completion notice must include a legal description of the property, the date the notice was sent, and the signer's name and address. Id.

When completed, the Notice must be posted on the date it bears in some conspicuous place upon the land or upon the improvement situated thereon. O.R.S. 87.045(3). A copy of the Notice must also be recorded within five days from the date of its posting, by the party posting it (or his or her agent), in the recording office of the county in which the property, (or some part) is situated. Id. A copy of the notice, together with an affidavit made by the person posting the notice, stating the date, place and manner of posting the notice, must be attached to the Notice of Completion when it's recorded. Id.

Anyone claiming a lien created on the premises described in a completion or abandonment notice for labor or services performed and materials or equipment used prior to the date of the notice must perfect the lien on the 75th day after work on the construction of the improvement ceases. O.R.S. 87.045(4).

Proper use of a Notice of Completion will protect property owners by allowing them to know who might have a potential lien claim and start the clock ticking for the time to record such liens.

While it's nice to get all the forms and info in one package for a reasonable cost, the fixed format of the form does not allow for a lengthy meet and bounds property description for real property. Also, the Cover Sheet has big fillable sections with no instructions about what's supposed to go there. I tried the "Contact Us" link, but all it does is spin saying it's trying verify the security of my connection. Looks like I;m going to have to create my own deed in MS Word instead of just filling in the blacks of the PDF file that I downloaded. Bummer!

It's useful to have forms specific to the County as well as the State. The examples are also helpful, but it would be even more helpful to see an example of a complete and successfully filed package. I will go the County Recorder's Office to see if I can find an example there.

This was the first time I had ever had to fill out a Warranty Deed, so if it was not for your example form on how to fill one out, I would be still be here completely lost. I had originally gone to another site for a Warranty Deed & they wanted double the amount of your price & their website had no examples forms. I am so happy with your site & service. The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem.

Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description!

Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.
