4. Avoiding Confusion: Filing the full Contract for Deed might create unintended legal implications or confusion, especially if specific terms are subject to further negotiation or amendment.
Situations to Consider Filing a Memorandum of Contract:
• Statute of Frauds (Idaho Code § 9-505): This statute mandates that certain agreements, including those for the sale of real property or interests therein, must be in writing to be enforceable. It specifies that such agreements are invalid unless there is a written note or memorandum signed by the party to be charged.
• When Selling on Terms: If you're using a Contract for Deed to sell real estate with financing, the Memorandum can signal the agreement without revealing terms like purchase price, interest rates, or payment schedules.
• Protecting Negotiations: If the details of the Contract for Deed are sensitive to competitive or personal concerns, a memorandum can suffice.

What Should a Memorandum of Contract Include?
A Memorandum of Contract should include:

instead of the rep giving me instructions on how to summit the documents,with 3 pages, he or she told me i had all night to figure it out!!! wow...because of that i rate the service very poorly...fast to get it done but very poor customer service...so...i give them a 2.5 rating.

The service was prompt and attentive to my questions. I would've just appreciated a heads up that I also needed to contact the county directly (and provide contact info) to receive a certified copy of the document (Notice of Commencement) in order to submit the certified copy to the Building Department. This was an extra step that I haven't had to complete before using another eRecording service. Even if this extra step is a result of the county's system. I would still have expected a head's up (since there wasn't any info regarding this on the county's site for eRecording).

it was convenient to have a starting place, however, though the property is in Colorado, the probate is in Iowa, so I had to create my own document because you locked my capacity to edit the form I paid for. If I pay for it, I should be able to edit everything including non fill in text. I could not open it in word, as I normally could.
