Use this form to assign an existing mortgage to another party.
Formatted for recordation in the [Registry of Deeds] or [Land Court Registry], approximately 15 to 20% of land in Massachusetts is registered land, meaning the land is insured by the Commonwealth of Massachusetts, and documents affecting real property must be recorded in the Land Court.
Section 28. In an assignment of a mortgage of real estate the word ''assign'' shall be a sufficient word to transfer the mortgage, without the words ''transfer and set over''.
Mortgage broker endorsement included.
Section 6D. Every mortgage and assignment of mortgage secured by residential property, as defined in section 1 of chapter 255E, presented for record, in which a mortgage broker, as defined in said section 1 of said chapter 255E, is involved shall contain or have endorsed upon it the name, post office address and license number of the mortgage broker and, if applicable, the mortgage loan originator, as defined in section 1 of chapter 255F, responsible for placing the mortgage loan with the mortgagee. This endorsement, or notation that no mortgage broker or mortgage loan originator was involved in the mortgage, if known, shall be recorded as part of the mortgage or assignment of mortgage. Failure to comply with this section shall not affect the validity of any mortgage or the recording of any mortgage or assignment of mortgage.
When a mortgage is assigned, proper disclosures must be presented to current borrower(s). Generally within 30 days to avoid penalty. Included is a "NOTICE OF ASSIGNMENT OF MORTGAGE" document.

After some initial general confusion -- (we sold a small piece of land privately and therefore do not typically prepare such documentation (!)) -- we were able to purchase and download all forms from Deeds.com and understand how to complete it/them. The help is all there, we just needed to read and study it - the "Example" helped alot. We were able to complete the Document per your online form(s) and then take it to be signed/notarized - and take the completed paper document to the Registry -- and it is now all registered and we are All Set. rn Took the morning (only). Easy to use website and immediate documents appropriate for my area. My only complaint is that the forms had an alignment problem where the fields that were filled in by me did not line up with the template text. I tried to correct it to no avail so I ended up having to retype the entire document. I purchased two templates and both had the same issue.

This site was easy to use for access to State forms for filing in Montmorency County clerks office. Not only did I find claim form but a sample claim was available for assisting on how to complete your form correctly. Found this so very useful for us (public resident) to fill in the form as a .PDF file that prints out typed form - rather than handwritten entries. There is a fee but your access is always available on internet to this site in the future. Saved me time using this site and My filed form looks professional. You have access to several other forms if needed.

Pros, quick purchase and document availability including instructions and examples.
Cons, For the cert. of trust, the form would not accept the length of our trust name with no way to get around. The pdf file printing did not meet the requirements for 2.5" top margin and .5" other margins as well as the 10pt font size as the form information was shrunk down even when normal printing.
