This is a Durable General Power of Attorney governed by Massachusetts Uniform Probate Code, M.G.L. c.190B. A power of attorney is considered durable when (a principal, in writing, designates another as his attorney in fact and the writing contains the words, "This power of attorney shall not be affected by subsequent disability or incapacity of the principal", or "This power of attorney shall become effective upon the disability or incapacity of the principal", or similar words showing the intent of the principal that the authority conferred shall continue notwithstanding the subsequent disability or incapacity of the principal.)(MA Gen L ch 201B statute 1, Section 1. (a))

Great to have a downloadable form, rather than a cloud solution that gives no guarantee of privacy. Appreciated the sample.......but all of that still left me with open issues about how to tweak the form to serve my particular needs......for example: how to ensure that survivor rights were properly characterized; how far back I should go with the "Source" section + how I should layer my own additions to the chain of ownership, etc. Nonetheless, an overall happy experience. Lee County, FL did accept the "Satisfaction of Mortgage" form. It was easy to fill out except for a couple of areas. Your fill in areas need to accommodate for whatever space needed for the pertinent information we as customers have to fill out. As individuals, banks have their own. Example when there are more than 1 party and information needed. Example of Document #; I was 1 number short (using Exhibit A was ridiculous.) So I had to write in the # after printing. Very unprofessional looking on a legal document. Just saying. Also, in Lee County, FL your document # is called "Instrument #, not said in your instructions. Hope this information helps for updates on your forms.
