About New York Recording
Real estate deeds that transfer property in New York can be recorded to provide constructive notice of the transfer. In most cases deed documents are recorded in the county where the property is located and maintained by the county clerk or recorder.
New York requirements for real estate deed documents:
- Documents must include the names of grantors and grantees, a legal description of the property, and the amount of consideration.
- For a transfer of interest in real property subject to New York State Real Property Transfer Tax, the TP-584 must be filed.
- For all counties outside the city of New York, a deed must be accompanied by the Real Property Transfer Report (RP-5217), which is issued by the New York State Office of Real Property Services
- All real property documents must be duly signed and acknowledged.
Note that all assignments presented for recording must also contain a complete listing of any prior transfers related to the same mortgage.
